RESOLUTION NO. 79 <br /> SERIES 2011 <br /> A RESOLUTION APPROVING A PRELIMINARY SUBDIVISION PLAT AND <br /> PRELIMINARY PLANNED UNIT DEVELOPMANT (PUD) PLAN FOR 96th STREET <br /> AND DILLON, A COMMERCIAL SUBDIVISION OF THE ST. LOUIS PARISH AND <br /> COMMERCIAL PARK. <br /> WHEREAS, there has been submitted to the Louisville City Council an <br /> application for approval of a Preliminary Subdivision Plat and Preliminary PUD Plan 96th <br /> Street and Dillon Subdivision; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found it to <br /> comply with the St. Louis Parrish and Commercial Park General Development Plan <br /> (GDP) and the Louisville Municipal Code Sec. 16.12.030 and Sec. 17.28.170; and <br /> WHEREAS, after a duly noticed public hearing on October 13, 2011, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville Planning Commission Staff Report dated October 13, 2011, the Planning <br /> Commission recommended approval of said Preliminary Subdivision Plat and <br /> Preliminary PUD Plan with the following condition: <br /> 1. Preliminary recommendation of approval of the proposed public land <br /> dedication and payment-in-lieu of a dedication is subject to a current <br /> appraisal being provided to the City during the Final Plat and Final PUD. <br /> WHEREAS, City Council has reviewed the application, including the <br /> recommendation of the Planning Commission, and finds that it complies with Chapter <br /> 17.40.100 of the Louisville Municipal Code; <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Louisville, Colorado does hereby approve a Preliminary Subdivision Plat and <br /> Preliminary PUD Plan for the 96th Street and Dillon, a Commercial Subdivision of the <br /> St. Louis Parish and Commercial Park. with the following condition: <br /> 1.
