City Council <br /> Meeting Minutes <br /> October 18, 2011 <br /> • Page 16 of 17 <br /> Conservation Easement, the seller has represented they will sell Tract B to the City for a <br /> purchase price of $125,000. The City has forty-five (45) days to notify the property <br /> owner if the City desires to purchase Tract B or waive its right to purchase Tract B. <br /> The Deed of Conservation Easement preserves the property's open space values, <br /> which will continue with a change in ownership thereby protecting, preserving and <br /> providing a public benefit without ownership by the City. The conservation easement <br /> protects the property in perpetuity with regard to the open space function it was <br /> intended to serve, and in this economic climate, the city avoids the cost of maintenance. <br /> Should the City Council desire to purchase the property, funds are available within the <br /> Conservation Trust Land Acquisition Fund for the acquisition of Tract B. <br /> Staff recommended the City Council authorize the Mayor to execute the necessary <br /> forms in order to waive its right to purchase Tract B. The Deed of Conservation <br /> Easement runs with the property and sufficiently protects and preserves the land as <br /> open space which was, and is, the intended use. <br /> PUBLIC COMMENT <br /> Caryn Greef, 161 S. Raintree Lane, Louisville, CO urged Council to consider purchasing <br /> • the property for recreational purposes. She felt when funds are available the five-acre <br /> parcel would be a nice enhancement to the City and perhaps include a dog park. She <br /> stated her understanding $600,000 of the Open Space Fund is proposed to pay for the <br /> McCaslin/Washington underpass. She stated the voters of Louisville did not envision <br /> using the tax for an underpass. She felt the property has value. <br /> COUNCIL COMMENTS <br /> Mayor Sisk stated the property in question has no public parking and would be very <br /> difficult to access. He did not support spending $125,000 for the property. <br /> MOTION: Councilor Muckle moved to authorize the Mayor to execute the necessary <br /> forms in order to waive its right to purchase Tract B, seconded by Councilor Dalton. <br /> Roll call vote was taken, the motion carried by a vote of 6-0. <br /> CITY ATTORNEY'S REPORT <br /> City Attorney Light reported the City staff has received a request for a reasonable <br /> accommodation under the Fair Housing Act. The Municipal Code contains a Fair <br /> Housing ordinance, which regulates private activities. The ordinance was adopted prior <br /> to the time the federal law established a reasonable accommodation requirement. The <br /> City's ordinance does not have a clearly defined process for handling such requests. <br /> Staff is preparing a legislative process to amend the Code and to put a mechanism in <br /> • place to address requests for reasonable accommodations. <br />
