<br />17.56.260 Special exception permits - additional conditions <br /> <br />Upon consideration of the factors indicated in Section <br />17.56.250 and the purposes of this chapter, the zoning board <br />of adjustment may attach, in addition to those conditions <br />required by special permits, such conditions as it deems <br />necessary for furthering the purposes of this chapter. Such <br />conditions may include, without limitation because of specific <br />enumeration, modification of other waste-disposal methods <br />and facilities, landscaping, periods of operation, operational <br />controls, sureties, deed restriction, and adequate floodproofing, <br />and shall include provisions for floodproofing water and sanitary <br />systems. <br /> <br />SECTION 14. Section 17.56.270 (G) of the Louisville Municipal <br /> <br />Code is hereby repealed. <br /> <br />SECTION 15. The following subs ection s, G, K and L are hereby <br /> <br />added to Title 17, Chapter 17.56, Section 17.56.270 of the Louisville <br /> <br />Municipal Code: <br /> <br />G. Construction of all new and replacement water supply <br />systems shall be designed to eliminate or minimize <br />the infiltration of flood waters into the system; <br /> <br />K. New and replacement sanitary sewage systems shall be <br />designed to eliminate or minimize the infiltration of <br />flood waters into the systems and discha.rge from the <br />systems into flood waters; and <br /> <br />L. On-site waste disposal systems shall be located to <br />avoid impairment to them or contamination from the <br />systems during flooding. <br /> <br />SECTION 16. Sectjlon 17.56.280 (A) of the Louisville Municipal <br /> <br />Code is hereby repealed. <br /> <br />SECTION 17. The following subsection (A) is hereby added to <br /> <br />Title 17, Chapter 17.S6, Section 17.56.280 of the Louisville <br /> <br />Municipal Code: <br /> <br />A. The building official shall request the applicant, when <br />applicable, to submit a certification by a registered <br />professional engineer that the finished fill and building <br />flood elevations, the existance of basements, flood- <br />proofing measures including the elevation (in relation to <br />mean sea level) to which the structure was floodproofed, <br />and other flood protection factors were accomplished in <br />compliance with provisions of this chapter. All such <br />certificates shall be retained by the building official for <br />public inspection. <br /> <br />SECTION 18. The following subsections (D) & (E) are hereby added to <br /> <br />Title 17, Chapter 17. S6, Section 17.56.150 of the Louisville <br /> <br />Municipal Code: <br /> <br />-8- <br />
