<br />CITY OF LOUISVILLE <br />RESOLUTION 3 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO, <br />ENDORSING H.R. 1522 and S.B. 801, RELATIVE TO "HOLD HARMLESS" <br />PROVISIONS OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974. <br /> <br />WHEREAS, with the passage of the Housing and. Community <br /> <br />Development Act~of 1974, the Congress and President of the United <br /> <br />States of America provided a vehicle through which communities <br /> <br />throughout our Nation could continue to improve their physical and <br /> <br />social environment, and <br /> <br />WHEREAS, certain funding levels were established under the <br /> <br />Act through "Hold Harmless" provisions whereby communities pre- <br /> <br />viously participating in categorical programs would continue to <br /> <br />receive funds from the federal government for five (5) program <br /> <br />years following the passage of the Act, and <br /> <br />WHEREAS, these funding levels would remain constant for the <br /> <br />first three (3) years, 1975, 1976, and 1977 and thereafter reduce <br /> <br />to 2/3 of the initial funding level in the fourth year, 1978, <br /> <br />and 1/3 of the initial funding level in the fifth year, 1979, with <br /> <br />complete phase-out and a zero entitlement funding level in the <br /> <br />sixth year, 1980, leaving the majority of thc,se communities <br /> <br />actively participating in these programs in the past with no <br /> <br />assured annual Federal funds to comby their community development <br /> <br />problems, and <br /> <br />WHEREAS, those communities under 50,000 population, of which <br /> <br />there are over 750 across the Nation, will not receive a "Formula" <br /> <br />share of Community Development Funding and, therefore, in crder <br /> <br />to continue their ~prpgrams, they will be required to incur <br /> <br />considerable 10cal expense, and <br /> <br />WHEREAS, Congressman Henry S. Reuss introduced H.R. 1522 on <br /> <br />January 6, 1977, and a companion Bill, S. 801, was introduced in <br /> <br />the Senate, both of whi~h call for the removal of the phase-out <br /> <br />provisions of the Act by elimination of Section 106 (h) (2) thereof, <br /> <br />thereby effectively contin~ing the Community Development funding <br /> <br />at its initial level into the fourth (4th) and subsequent years <br /> <br />-1- <br />
