Davidson called for staff presentation on Ordinance No. 1330, Series 2000, Ordinance <br />1331, Series 2000, and Resolution No. 9, Series 2000, and opened the public hearing. <br /> <br />Sam Light, City Attorney clarified that items G, H, and I, all pertain to the Bowes <br />Annexation. Enclosed in the Council packet, is Item I., Resolution No. 10, Series 2000, <br />finding that the property is eligible for annexation into the City, Item G., Ordinance No. <br />1330, Series 2000, is an Ordinance Approving the Annexation, first reading, and Item H., <br />Ordinance No. 1331, Series 2000, the Zoning Ordinance, sets a public hearing. Light <br />stated that in considering an annexation, it was appropriate to discuss land use issues and <br />community issues. Some of the testimony and discussions will be considered at the <br />formal public hearing on second reading of the Zoning Ordinance. <br /> <br />Paul Wood, Planning Director, reviewed Ordinance No. 1330, Series 2000, which has <br />been properly published. He stated that Mr. Jack Bowes is the applicant and is <br />represented by Chuck Keim, of Charles Keim & Associates. The parcel is located at the <br />southeast comer of Dillon Road and South 88th Street. Ordinance No 1330, Series 2000, <br />if authorized, would annex approximately 77.87 acres to the City of Louisville. With the <br />exception of a portion of the west property boundary, the subject parcel has full <br />contiguity with properties annexed within the City of Louisville. Approximately 84 <br />percent of the total perimeter is contiguous which exceeds the 1/6 criteria by state <br />statutes. The contiguity is established on the north by Dillon Road, which was annexed <br />to the City in August of 1996. Wood stated there were two annexations that annexed the <br />full length of the property from Dillon Road to the intersection of 96th tO 88th Street. The <br />contiguity on the west was established by the annexation of the Admore parcel, now <br />currently owned by the City and County as open space. To the south there is full <br />contiguity with the Louisville Campus, which annexed 80.77 acres in September of 1996. <br />To the west there is a portion of land purchased by the City of Louisville for the <br />realignment of 88th Street. <br /> <br />Wood noted that the initial public hearing set for December 7, 1999 of Ordinance No. <br />1330, Series 2000, was vacated by City Council, at the request of the applicant. The <br />public hearing was reset for February 1, 2000, and all notification and advertising <br />requirements have been complied with for the annexation public hearing. The public <br />hearing was reset to allow staff and the applicant additional time to complete the required <br />annexation agreement. Staff and the City Attorney's Office have specifically reviewed <br />Section 14 of the Bowes Annexation Agreement where the applicant is requesting to <br />establish a minimum density as well as standards for infrastructure related issues. <br /> <br />Wood stated that the applicant is seeking to establish a minimum density of 20 units (19 <br />plus the homestead) within what is proposed to be zoned Restricted Rural Residential (R- <br />RR). The zoning of the subject property is being considered by a subsequent ordinance. <br />If authorized by City Council, the R-RR zoning would allow 16 units. It is the position <br />of staff, that any density increase through the PUD process should be created through the <br />quasi-judicial PUD process as required by the Municipal Code. An annexation agreement <br />would need to be finalized prior to passage of any annexation ordinance on final reading. <br /> <br />13 <br /> <br /> <br />
