<br />ORDINANCE NO. 445 <br /> <br />AN ORDINANCE PROVIDING FOR THE INSTALLATION OF WATER METERS UPON THE <br />SALE OR TRANSFER OF ANY PROPERTY SERVED WITH WATER BY THE CITY OF <br />LOUISVILLE AND REPEALING ALL PARTS OF ANY ORDINANCES IN CONFLICT HEREWITH. <br /> <br />WHEREAS, the City IOf Louisville presently requires all new <br /> <br />water users tapping into City's water system to be installed with a water <br /> <br />meter, and <br /> <br />WHEREAS, it is deemed advisable by the City Council of the City of <br /> <br />Louisville in order to conserve water in the future to provide for the <br /> <br />orderly installation of water meters throughout the City in a manner so as <br /> <br />to create only a minimum hardship on the present owners of property <br /> <br />within the City. <br /> <br />NOW THEREOFRE, Be It Ordained by the City Council of the City <br /> <br />of Louisville: <br /> <br />Section 1. Upon the transfer of any real property being served with <br /> <br />water from the City of Louisville's Water System, the new owner shall be <br /> <br />required to purchase and install water meters according to plans and <br /> <br />specifications of the City of Louisville within 90 days from the date of <br /> <br />such transfer unless such time is extended in writing by the City Manager <br /> <br />due to the unavailability IOf materials or weather. <br /> <br />Section 2. In the event of the failure of the new owner to comply <br /> <br />with this ordinance, the City shall have the right to shut off the water <br /> <br />supply to said real property without notice. Said water supply shall not <br /> <br />be turned on again until full compliance with this ordinance is performed <br /> <br />by said owner or owners. In the event it is necessary by the City to shut <br /> <br />off water supply pursuant to this ordinance, a service fee of $10.00 shall <br /> <br />be paid to the City for turning said water on. <br /> <br />Section 3. Definitions. <br /> <br />(a) Owner. Own'er means and includes any ind i vidual, firm, <br /> <br />co-partnership, joint venture, association, fraternal organization, <br /> <br />corporation, estate, trust, in singular or plural, who is the record <br />
