<br />CITY OF LOUISVILLE <br />Ordinance No. 456 <br /> <br />AN ORDINANCE PROVIDING FOR RULES AND REGULATIONS OF AREAS LOCATED <br />WITHIN THE CITY OF LOUISVILLE, COLORADO SUBJECT TO FLOODING; PRO- <br />VIDING FOR FLOOD DISTRICTS; PROVIDING FOR THE ADMINISTRATION OF <br />SAID RULES AND REGULATIONS; AND PROVIDING FOR THE EMERGENCY ADOP- <br />TION OF THIS ORDINANCE. <br /> <br />WHEREAS, it is deemed necessary to adopt rules and regulations for <br />areas within the City of Louisville subject to flooding in order to pro- <br /> <br />mote the public health, safety and general welfare of the citizens of <br /> <br />Louisville, Colorado, <br /> <br />NOW, THEREFORE, Be It Ordained by the City of Louisville, Colorado: <br />SECTION 1.0 STA'UTORY AUTHORIZATION FINDINGS OF FACT AND PURPOSE. <br /> <br />1.1 Statutory Authorization: This ordinance for flood prevention <br /> <br />and control is adopted pursuant to the authority contained in Section 139- <br />60-1, Colorado Revised Statutes 1963, as amended. <br />1.2 Findings of Fact: The City Council finds that there are within <br />the City of Louisville various floodplains constituting natural hazards of <br />state and local interest, the occupation of which is likely to cause the <br /> <br />loss of human life and the destruction of property, and that the imprudent <br /> <br />occupation of these floodplains will pose a continuing and greater future <br />danger to life and property, unless proper regulations are adopted concerning <br /> <br />their use and occupation. <br />1.3 Purpose: The purpose of this ordinance is to promote the public <br />health, safety, and general welfare, to minimize flood losses in areas <br /> <br />subject to flood hazards, and to promote wise use of the flood plain, this <br />flood plain ordinance has been established with the following purposes in- <br /> <br />tended: <br />1.31 To reduce the hazard of floods to life and property by: <br />1.311 Prohibiting uses which are dangerous to life or property and/or <br /> <br />which are hazardous to the public in time of flood. <br />
