<br />CITY OF LOUISVILLE <br /> <br />Ordinance No. 480 <br /> <br />AN ORDINANCE PROVIDING FOR THE PROTECTION OF TREES WITHIN THE CITY OF <br />LOUISVILLE AND PROVIDING FOR THE CARE OF OR THE REMOVAL OF DISEASED <br />AND DANGEROUS TREES. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, <br />COLORADO. <br /> <br />Section 1. The following code is hereby adoQted for the pro- <br />tection of trees within the City of Louisville, C010rado: <br /> <br />"1. City Administrator to employ Forester. The City Admini- <br />strator or appropriate off'icial shall employ a person to be known as <br />the City Forester, whose powers and duties are hereafter specified. <br /> <br />2. City Administrator's Power to Adopt Rules and Specifications. <br />The City Administrator sha'll have the power to promulgate rules, regulations, <br />and specifications for the trimming, spraying, removal, planting, pruning, <br />and protection of trees, shrubs, vines, hedges, and other plants upon the <br />public right-of-way of any street, alley, sidewalk, or other public place <br />in the City. <br /> <br />3. City Administrator's Power to Trim Trees and Collect Costs. <br />3-1. The City Administrator, through the City Forester, shall have the <br />power to trim, spray, remove, plant, and protect all trees, shrubs, vines, <br />hedges, and other plants upon the public right-of-way of any street, alley, <br />sidewalk, or other public place, or to require the owner of property abutting <br />on the right-of-way of any street, alley, sidewalk, or other public place <br />to trim, remove or protect any tree, shrub, vine, hedge, or other plant which <br />may project beyond the property line of such owner, onto or over public pro- <br />perty at the expense of such owner. <br /> <br />3-2. If the property ownel' refuses or neglects to trim, protect, or remove <br />any such tree, shrub, vine" hedge, or other plant within ten (10) days after <br />receipt of a written noticE~ from the City Forester so to do, the City Fo- <br />rester may do or cause to be done the necessary work incident thereto, and <br />the expenses thereof shall be collected from the owner of such property. <br /> <br />4. Removal of Dead or Dangerous Trees. <br />4-1. It shall be the duty of the owner or occupant of any property to remove <br />any dead tre~s or dead, overhanging boughs dangerous to life, limb, or property <br />located on the premises of such owner. Upon receipt of written notice from the <br />City Forester so to do and within such reasonable time as specified in said <br />notice. The City shall be responsible for the removal of the dead or invested <br />trees on public property, however, the owner of the property abutting the <br />public property shall be rE!sponsible for normal maintenance of said trees <br />except where such trees are in a public park. <br /> <br />4-2. If such owner fails to remove same within the time required, the City <br />Forester is authorized to remove or cause to be removed such trees or branches <br />at expense of such owner; such expenses may be recovered in a proper action <br />at law, including reasonable attorney fees. <br />
