<br />RESOLUTION NO. 37 <br />SERIES 1997 <br /> <br />A RESOLUTION SUBMITTING A BALLOT ISSUE TO A VOTE OF THE <br />REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT THE <br />COORDINATED ELECTION TO BE HELD NOVEMBER 4, 1997 <br /> <br />WHEREAS, the City will hold an election on November 4, 1997, <br />as a coordinated election pursuant to the Uniform Election Code of <br />1992, as amended; and <br /> <br />WHEREAS, an intergovernmental agreement has been proposed <br />between the City of Louisville and the Town of Superior; and <br /> <br />WHEREAS, the proposed agreement has been approved by the City <br />Council of the City of Louisville and the Board of Trustees of the <br />Town of Superior; and <br /> <br />WHEREAS, according to its terms, the proposed agreement is to <br />be submitted to a vote of the registered electors of the City of <br />Louisville and the Town of Superior at the election to be held on <br />November 4, 1997; and <br /> <br />WHEREAS, the City Council finds it is in the best interest of <br />the City to refer a ballot issue concerning the intergovernmental <br />agreement to a vote of the registered electors of the City at the <br />November 4, 1997, election, pursuant to Article X, Section 20 of <br />the Colorado Constitution. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The following ballot issue, certified in <br />substantially the form set forth below, is hereby referred to the <br />registered electors of the City and shall appear on the ballot of <br />the City of Louisville special municipal election to be held on <br />November 4, 1997: <br /> <br />WITHOUT INCREASING ANY EXISTING TAX RATES AND WITHOUT <br />IMPOSING ANY NEW TAXES, SHALL THE CITY OF LOUISVILLE, <br />COLORADO ("CITY") BE AUTHORIZED TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE TOWN OF SUPERIOR, <br />COLORADO ("TOWN"), WHICH AGREEMENT INCLUDES A MULTIPLE <br />FISCAL YEAR OBLIGATION OF THE CITY, FOR THE PURPOSE OF <br />SHARING BY THE CITY AND TOWN OF SALES TAX REVENUES <br />GENERATED FROM PARCELS OF LAND LOCATED ADJACENT TO OR <br />NEAR U. S. HIGHWAY 36 AND DESCRIBED IN THE AGREEMENT, AND <br />FOR THE PURPOSE OF ADDRESSING DISCONNECTION, ANNEXATION, <br />AND OTHER ISSUES CONCERNING THE PARCELS OF LAND, THE <br />LOUISVILLE/SUPERIOR INTERCHANGE AT MCCASLIN BOULEVARD AND <br />U.S. HIGHWAY 36, AND OTHER MATTERS CONTAINED IN SUCH <br />AGREEMENT; AND SHALL THE CITY BE AUTHORIZED TO COLLECT, <br />RETAIN, AND EXPEND THE FULL AMOUNT OF SALES TAX REVENUE <br /> <br />1 <br />
