<br />notice of refunding and redemption one or more times in a <br /> <br /> <br />newspaper or newspapers customarily used by the City for <br /> <br /> <br />legal notices. <br /> <br /> <br />The notice shall again be published in such newspaper <br /> <br /> <br />or newspapers before the Prior Redemption Date of the 1975 <br /> <br /> <br />Issue, by insertion therein once, publication to be not less <br /> <br /> <br />than thirty (30) days prior to said Prior Redemption Date. <br /> <br /> <br />Said notice shall also be sent by registered or certified, <br /> <br /> <br />prepaid first-class United States mail, at least thirty (30) <br /> <br /> <br />days prior to said Prior Redemption Date to Boettcher & Company, <br /> <br /> <br />Denver, Colorado, its successors or assigns. Said notice shall <br /> <br /> <br />describe the bonds to be called and paid by number, amount and <br /> <br /> <br />date of issue, the place of redemption, the date on which the <br /> <br />same will be redeemed and shall state that after such date <br /> <br /> <br />the interest on said bonds will cease. <br /> <br /> <br />Section 13. The City covenants and agrees that it <br /> <br /> <br />will make no use of the proceeds of the bonds authorized <br /> <br /> <br />herein which might cause such obligations to be arbitrage <br /> <br /> <br />bonds within the meaning of Section 103(d) of the Internal <br /> <br /> <br />Revenue Code of 1954, as amended, and the Regulations proposed <br /> <br /> <br />and in effect thereunder. <br /> <br /> <br />Section 14. That if anyone or more section or <br /> <br /> <br />part of this Ordinance shall be adjudeged unenforceable or <br /> <br />invalid, such judgment shall not affect, impair or invalidate <br /> <br /> <br />the remaining provisions of this Ordinance, it being the <br /> <br /> <br />intention that the various provisions hereof are severable. <br /> <br /> <br />Section 15. All ordinances or parts thereof in <br /> <br /> <br />conflict with this Ordinance are hereby repealed. <br /> <br />Section 16. After said Refunding Bonds are issued, <br /> <br /> <br />this Ordinance shall be and remain irrepealable until said bonds <br /> <br /> <br />and the interest thereon have been fully paid, satisfied and <br /> <br /> <br />discharged. <br /> <br />Section 17.
