Phare stated that at the time of the preliminary discussions, the County did not have any
rights they wished to release. However, in more recent discussions, the County has
indicated a willingness to help the City acquire CBT units from future open space
acquisitions.

Sisk requested the $90,000 dollar be earmarked for purchase of additional water
acquisition.

Bill Simmons, City Administrator stated that the City could make sure that the money
received from this sale is directed toward water rights acquisition.

Davidson stated that the Water Committee recently met and it was their opinion to be
more aggressive in acquisition of water rights, due mainly to the skyrocketing cost of
water rights. He stated there is substantial revenue in the water fund for the purchase of
water rights. He noted the City has concentrated on CBT water, but with the costs, will
begin to look at a broader range of water right acquisitions.

Levhin moved that the Council approve Resolution No. 15, Series 2000, Approving a
Purchase Agreement to Buy and Sell Water Rights, seconded by Mayer.

Sam Light, City Attorney, proposed an amendment that the Resolution reflect the correct
title of the agreement.

Levihn and Mayer accepted the amendment.

Mayer proposed an amendment that the revenue collected be directed into the water fund
for future water rights acquisition.

Levihn accepted amendment.

Roll call was taken. Motion passed by a vote of 6-0.

ORDINANCE NO. 1326, SERIES 2000 - AN ORDINANCE PROVIDING FOR
THE TRADE AND SALE OF WATER RIGHTS BY AND BETWEEN THE CITY
OF LOUISVILLE AND BOULDER COUNTY - 2nd reading - public hearing -
continued from February 1, 2000 (advertised Daily Camera 01/22/00)

Davidson called for City Attorney introduction.

Sam Light, City Attorney read Ordinance 1326, Series 2000 - An ordinance Providing for
the Trade and Sale of Water Rights By and Between the City of Louisville and Boulder
County.
