<br />RESOLUTION NO. 41 <br />SERIES 1997 <br /> <br />A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN AND <br />FINAL SUBDIVISION PLAT FOR <br />CENTURY RETAIL CENTER <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Vintage Real <br />Estate Services for a Final PUD Development Plan and Final Subdivision Plat for the construction <br />of 33,000 sf of retail use; and <br /> <br />WHEREAS, all materials related to the Final PUD Development Plan and Final <br />Subdivision Plat have been reviewed by City Staff and the Planning Commission and found in <br />compliance with the Louisville Zoning Ordinances, Subdivision Regulations, Commercial <br />Development Design Guidelines and related policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan and Final Subdivision Plat, the Planning Commission recommended approval <br />with conditions to the City Council; and <br /> <br />WHEREAS, the City Council finds that said Final PUD Development Plan for Century <br />Retail Center should be approved with the following conditions: <br /> <br />1. That a shared parking agreement for the mutual benefit of both lots should be drafted by <br />the applicant, subject to the City's review and approval, and recorded with Boulder County <br />prior to the recording of the PUD and Plat; <br /> <br />2. That a public use dedication fee, in an amount approved by the City Administrator, is <br />incorporated into the Subdivision Agreement and paid prior to issuance of any building <br />permits; <br /> <br />3. That a separate monument sign package is submitted for Planning Commission and City <br />Council review and approval; <br /> <br />4. That no exposed neon be permitted on building mounted or monument signage. Individual <br />sign letters shall be covered with translucent plexiglass. <br /> <br />5. That upon over lot grading, the subdivider shall reseed disturbed ground cover in Phase <br />II and portions of Phase I which will not be developed concurrent with the first building <br />permit. There shall be no stockpiling of dirt on site, except that yardage which will be <br />required for back fill purposes for a building under an active building permit. <br />
