RESOLUTION NO. 46 SERIES 1997 A RESOLUTION APPROVING AN AMENDMENT TO AN ANNEXATION AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF LOUISVILLE, COLORADO. WHEREAS, on August 19, 1986, Richard F. Biella, George F. Menkick and Kyung Menkick entered into an Annexation Agreement with the City of Louisville; and WHEREAS, includes, but approximately and the property subject to the Annexation Agreement is not limited to, certain property consisting of 80.1 acres lying south of U.S. 36 (the "Property"); WHEREAS, the current owners of the Property have submitted to the City an application to disconnect the Property from the City pursuant to C.R.S. ~31-12-501 ~ ~.; and WHEREAS, as part of the potential disconnection of the Property from the City, an amendment to the Annexation Agreement has been proposed; and WHEREAS, the City Council finds the proposed Amendment to the Annexation Agreement is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Amendment to Annexation Agreement, a copy of which is attached hereto and incorporated herein by this reference, is hereby approved. 2. The Mayor is hereby authorized to execute the attached Amendment to Annexation Agreement on behalf of the City Council of the City of Louisville, except that the Mayor is hereby further authorized to negotiate and approve such revisions to the Amendment to Annexation Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Amendment are not altered. 3. The Amendment to Annexation Agreement approved by this Resolution shall become effective upon the effective date of the disconnection of the Property from the City by ordinance passed pursuant to C.R.S. ~31-12-501 ~ ~.
