<br />ORDINANCE NO. 399 <br /> <br />AN ORDINANCE PROHIBITING ANY LIQUOR OR FERMENTED MALT LIQUOR <br />LICENSEE FROM PERMITTING ANY DISTURBANCE, UNLAWFUL OR DIS- <br />ORDERLY ACTS OR CONDUCT TO BE COMMITTED UPON ANY LICENSED <br />PREMISES, PROVIDING A PENALTY FOR VIOLATION THEREOF AND <br />DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO, <br />AS FOLLOWS: <br /> <br />SECTION I. Definitions. As used in this ordinance the following words <br />or phrases shall have the following meaning: <br />(a) Three point two (3.2) beer. Any beverage obtained by the fermen- <br />tation of any infusion or decoction of barley, malt, hops or any similar product <br />or any combination thereof in water containing not more than three and two <br />tenths per cent (3.2%) alcohol by weight. <br />(b) Licensee. Any person duly licensed to sell spirituous vinous or <br /> <br />malt liquors or beverages in the city, or any agent, servant or employee of <br />such licensee. <br /> <br />(c) Malt Liquors. Shall include beer and shall be construed to mean <br />any beverage obtained by the alcoholic fermentation of any infusion or <br />decoction of barley, malt, hops or any other similar products or any com- <br />bination thereof in water, containing more than three point two per cent (3.2%) <br />of alcohol by weight. <br />(d) Medicinal liquors. Any liquor sold by a duly licensed pharmacist <br />or drugstore solely on bona fide doctor's prescription. <br />(e) Operator. A person licensed to sell three point two (3.2) beer, <br /> <br />malt, vinous, and spirituous liquors, other than medicinal liquors, for <br />beverage purposes at retail and who is engaged at any time during the calendar <br />year in such operation within the city. <br />(f) Premises. Allor any part of the physical boundaries of any esta- <br />blishment duly licensed for the sale of spirituous, vinous or malt liquor <br />or beverages in the city. <br />(g) Spirituous liquors shall be construed to mean any alcoholic <br />beverage obtained by distillation, mixed with water and other substances in <br />
