<br />Section 5. Othel" Unlawful Acts. <br />(a) No person shall sell, serve, give away, dispose of, exchange or <br />deliver, or permit the salE~, serving, giving away or procuring of any malt, <br />vinous or spirituous liquol~, as defined above, to or for any person under the <br />age of twenty-one years, to a visibly intoxicated person, or to a known habitual <br />drunkard. <br /> <br />(b) No person under twenty-one years of age shall obtain malt, vinous, <br />or spirituous liquor by misrepresentation of age or by any other method in <br />any place where malt, vinous, or spirituous liquor is sold. <br />(c) No person under twenty-one years of age may have in his possession <br />malt, vinous, or spirituous liquor in any store, in any public place, including <br />public streets, alleys, roads or highways, or upon property owned by the State <br />of Colorado or any subdivision thereof, or inside vehicles while upon the <br />public streets, alleys, roads,or highways. <br />(d) No parent or guardian shall knowingly or under conditions which <br />an average parent or guardi'an should have knowledge of, suffer or permit any <br />person under twenty-one years of age, of whom he or she may be a parent or guardian, <br />to violate the provisions of subsection (b) or (c) of this Section. <br />Section 6. Prosecution, Conviction. Prosecution or conviction under <br />this ordinance shall not prohibit prosecution or conviction under any other <br />applicable law or ordinanCE! and the penalties provided shall be accumulative <br />and in addition to all othE!r penalties incurred under such other applicable <br />law or ordinance enacted by the City. <br />Section 7. Not a Defense that Licensee was not on Premises. It shall <br />not be a defense that the licensee was not personally present on the premises <br />at the time such unlawful or disorderly act, conduct or disturbance took place; <br />provided, however, that an agent, servant or employee of the licensee shall <br />not be responsible hereundE!r when absent from the premises while not on duty. <br />Section 8. Penallty. Any person who violates any provisions of this <br />ordinance, upon conviction thereof, shall be fined not more than $300.00. or <br />imprisoned not more than gO days. <br /> <br />-3- <br />
