<br />AN ORDINANCE AMENDING CHAPTER 28 OF THE MUNICIPAL CODE OF THE CITY
<br />OF LOUISVILLE, BY ADDING SECTION 28.14 KEEPING OF JUNK PROHIBITED,
<br />REGULATING AND PROHIBITING THE KEEPING, STORAGE OR COLLECTION OF
<br />JUNK; DECLARING THE SAME TO BE UNLAWFUL AND A NUISANCE; PROVIDING
<br />EXCEPTIONS THERETO; AND PROVIDING PENALTIES THEREFORE.
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO:
<br />
<br />Section 1: Chapter 28 of the Municipal Code of the City of Louisville,
<br />entitled Garbage, Refuse and Weeds is hereby amended by adding a new Section
<br />28.14 Keeping of Junk Prohibited which reads as follows:

<br />28.14 Keeping of Junk Prohibited. It shall be unlawful to keep,
<br />store, or provide for the collection of junk within the City and that the
<br />keeping, storage, or collection of junk within the City is hereby declared
<br />to be a nuisance and is detrimental to the health, safety, convenience and
<br />general welfare of the citizens thereof.
<br />
<br />Junk is hereby defined to be any old, used or secondhand materials of
<br />any kind, including, without limitation, cloth, rags, clothing, paper, rubbish,
<br />bottles, rubber, iron, tires, brass, copper, or other metal, furniture,
<br />refrigerators, freezers, all other appliances, used motor vehicles or the
<br />parts thereof or therefrom, machines, apparatuses and contrivances, and parts
<br />thereof, which are no longer in use, any used building material, boards or
<br />other lumber, cement blocks, bricks, or brick bats, or other secondhand
<br />building material, or any discarded machinery, tractors, trucks, or auto-
<br />mobiles, or any other article or thing commonly known and classified as junk.
<br />
<br />The keeping, storage or collection of junk shall not be deemed unlawful
<br />or a nuisance when and if same is kept, stored or collected in completely
<br />enclosed buildings, and this ordinance shall not apply to any premises where
<br />a licensed motor vehicle dealer or a farm implement deaerconducts his er their
<br />business.
<br />
<br />The keeping or storage of any motor vehicle not having thereon a valid
<br />and unexpired certificate of inspection as required by the hws of the State
<br />of Colorado, on private property by any person not specifically exempted
<br />under this ordinance, shall be prima facie evidence of violation of this
<br />ordinance.
<br />
<br />It shall be unlawful for any person to violate any provision of this
<br />ordinance, and any person found guilty of violating any provision of this
<br />ordinance shall be punished for each violation by a fine of not more than
<br />three Hundred ($300.00) Dollars or by imprisonment for not more than ninety
<br />(90) days, or by both such fine and imprisonment; further, each act or
<br />omission in violation of one or more than one of the provisions hereof shall
<br />be deemed a separate violation of such provision, and for each calendar day
<br />during which any violation continues, a separate violation shall be deemed
<br />to have been committed.
<br />
<br />Section 2: If any provision of this Ordinance or the application
<br />thereof to any person or circumstances is held invalid, such invalidity
<br />shall not affect other provisions or applications of the Ordinance which
<br />can be given effect without the invalid provisions or application and to
<br />this end the provisions of this Ordinance are declared to be severable.
