<br />ORDINANCE No. 409 <br /> <br />AN ORDINANCE PROVIDING FOR THE REGULATION OF EXCAVATIONS IN <br />STREETS, ALLEYS, SIDE WALKS OR OTHER PUBLIC PLACES WITHIN <br />THE CITY OF LOUISVILLE, COLORADO, WHICH ORDINANCE SHALL BE <br />KNOWN AND ENTITLED AS CHAPTER 22B OF THE "LOUISVILLE <br />MUNICIPAL CODE" <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: <br /> <br />SECTION 1. The following chapter 22 B entitled "Excavations" is <br />hereby adopted and added to the Municipal Code of the City of Louisville, <br />Colorado. <br /> <br />EXCAVATIONS <br /> <br />Division 1. Generally <br />Sec. 22 B-1. Time and area limits for street obstructions. <br /> <br />It shall be unlawful to obstruct more than the space of one (1) blQck <br />and one (1) intersection at the same time in anyone (1) street or to keep the <br />same blocked for more than three (3) days. In the event of unforeseen <br />extenuating circumstances an applicant may apply for an extension of the three <br />(3) day limitation and, if after investigation of the extenuating circumstances, <br />the city engineer or his authorized representative may grant such extension, <br />providing valid reasons and circumstances exist and justify the extension. <br /> <br />Sec. 22 B-2. Safety measures and barricades required. <br /> <br />(a) It shall be unlawful for any person to dig up or cause to be dug <br />any hole, drain, ditch or any other excavation in any street, alley, sidewalk, <br />or other public place within the city without providing during the nighttime <br />sufficient warning lights, to be placed with a suitable barricade or temporary <br />fence around such hole, drain, ditch or other excavation in order to prevent <br />persons, animals and vehicles from sustaining injury or damage. <br /> <br />(b) During the daytime, the barricade shall be maintained but warning <br />lights are not required. <br /> <br />(c) Every excavation shall be protected at all times by traffic safety <br />appliances as prescribed by the city engineer in order to minimize the dis- <br />ruption of the flow of traffic in the vicinity of the excavation. <br /> <br />Sec. 22 B-3. Damage, removal, etc. of safety measures or barricades <br />prohibited. <br /> <br />It shall be unlawful to damage, displace or remove or interfere with any <br />barricade, warning light or any other safety applia8ce which is lawfully <br />placed around or about any street, alley, sidewalk or other excavations or <br />construction work in the city. <br /> <br />Sec. 22 B-4. Cuts; backfill. <br /> <br />(a) Any c~t in any pavement or surfacing shall be made in a neat manner <br />with square edges and corners. Such cut shall be made with a pavement saw. <br />All excess material taken from the cut and the excavation shall be trucked away <br />and disposed of by the holder of the permit at the time the cut and excavation <br />is made. <br /> <br />(b) Upon completion of the work, each excavator shall backfill excavations <br />
