<br />ORDINANCE NO. <br /> <br />_ ARTICLE I <br /> <br />APPLICATION OF REGULATIONS <br /> <br />Section 1-101. Title <br /> <br />This Ordinance shal I be cited as the "Subdivision Regulations" of the City <br />of Louisvil Ie, Colorado. <br /> <br />Section 1-102. Purpose <br /> <br />These regulations are designed and enacted in accordance with Chapter 139, <br />Article 59 of the Colorado Revised Statutes, 1963, as amended, for the pur- <br />pose of promoting the health, safety, morals, convenience, order, prosperity <br />and welfare of the present and future inhabitants of the City of Louisvi I Ie, <br />Colorado, by: encouraging the proper arrangement of streets in relation to <br />existing or planned streets and to the comprehensive development plan; pro- <br />viding for adequate and convenient open spaces for traffic, uti lities, access <br />of fire fighting apparatus, civil defense, recreation, sites for schools and <br />educational facilities and related structures; and regulating such other <br />matters as the City Planning Commission and City Counci I may deem necessary <br />in order to protect the best interests of the publ ie. <br /> <br />Section 1-103. Authority <br /> <br />No Final Plat of a subdivision shaJ I be approved and accepted by the City <br />Council unless it conforms to the provisions of this Ordinance. <br /> <br />Section 1-104. Control <br /> <br />(A) Whoever divides, or participates in the division of a lot, tract, or <br />parcel of land into two or more lots, sites or other divisions of -(and for <br />the purpose, whether immediate or future, of sale or bui Iding development, <br />whether residential, industrial, office, business or other use, shal I make <br />the transaction subject to the provisions of this Ordinance and a plat there- <br />fore must be submitted to and accepted by the City of Louisvi I Ie according <br />to the terms as here inset forth. The terms hereof sha II a f so i nc I ude and <br />refer to any division of land previously subdivided or platted. <br /> <br />The within provisions shal I be deemed not to apply to the fol lowing: <br /> <br />(I) Any division of a tract of land which creates parcels of land <br />each of which comprise thirty-five (35) or more acres of land <br />none of which is intended for use by multiple owners, where such <br />subdivision does not involve the creation of any new streets or <br />easements of access as may be determined by the Planning Commission; <br />(2) Any division of land to heirs through an estate proceeding; <br />(3) Any transfer of a part of another lot or parcel for the purpose of <br />enlarging an existing lot or parcel and does not create an addition- <br />al lot; <br />(4) Any division of land by virtue of the fo~eclosure of a deed of trust. <br /> <br />I-I <br />
