<br />/- <br /> <br />(d) Consideration. "Consideration" means and includes the sales <br />price paid or delivered or contracted to be paid or delivered in return <br />for the transfer of ownership or title to real property and shall include <br />the amount of any 1 i en, mOlrtgage, contract indebtedness, or other encum- <br />brance, either given to secure the purchase price, or any part thereof, <br />or remaining unpaid on the property at the time of sale. The term does <br />not include the amount of any outstanding lien or encumbrance in favor <br />of the United States, the State, or a municipal corporation for taxes, <br />special benefits, or improvements. <br /> <br />Section 2. Documentary Fee Imposed, Amount and To Whom Payable: <br /> <br />There is imposed and shall be paid by every person offering for <br />recording in the Office of the County Clerk and Recorder of Boulder <br />County, any deed or instrument in writing, wherein or whereby title <br />to real property situated in this City is granted or conveyed, a fee, <br />hereinafter called Documentary Fee, measured by the consideration paid <br />or to be paid for such grant or conveyance, which Documentary Fee shall <br />be in addition to any other fee fixed by law for the recording of such <br />deed or instrument in writing. <br /> <br />(a) The amount of the Documentary Fee payable in each case shall <br />be as follows: <br /> <br />1. Where there is no consideration or when the consideration, <br />inclusive of the amount of any lien or encumbrance against the property <br />granted or conveyed, is Fiv,e Hundred Dollars ($500.00) or less, no Docu- <br />mentary Fee shall be payabl,e. <br /> <br />2. Where the consideration, inclusive of the amount of <br />any 1 ien or encumbrance aga'inst the property granted or conveyed, shall <br />exceed Five Hundred Dollars ($500.00), the Documentary Fee payable shall <br />be computed at the rate of one percent (1%) of such consideration. <br /> <br />3. All Documentary Fees shall be payable to and collected <br />by the County Clerk and Recorder who shall, at least once a month, distribute <br />to the City of Louisville, ninety-five percent (95%) of the Documentary <br />Fee collected on grants and conveyances of real property located in the <br />City of Louisville. <br /> <br />Section 3. Lien and Collection: <br /> <br />The amount of the Doc:umentary Fee imposed by this Ordinance is <br />hereby assessed against the property upon the transfer of which the tax <br />is imposed, and if not paid when due, such tax shall constitute a special <br />assessment against such property and shall be a lien on the property for <br />the amount thereof, which lien shall continue until the amount thereof <br />is paid or until it is discharged of record. The City Attorney may bring <br />an action in the courts of this State or any other State of the United <br />States in the name of the City of Louisville to collect the amount delinquent. <br /> <br />Section 4. Exemption.: <br /> <br />(a) The Documentary Fee imposed in this article shall not apply to: <br /> <br />1. Any deed wherein the United States or any agency or <br />instrumentality thereof or the State of Colorado or any political sub- <br />division thereof is either the grantor or the grantee. <br /> <br />- 2 - <br />
