<br />10-4 The Use Tax impOsE!d by this section shall be collected by <br />the authorized agent of the Depa.rtment of Revenue in the County in which the <br />purchaser resides. <br /> <br />10-5. The proceeds of said Use Tax shall be paid to the City periodi- <br />ca lly in accordance with an agre!ement entered by and between the City and the <br />authorized County Agency of the Department of Revenue. <br /> <br />10-6. The City Treasurer and the Mayor are hereby empowered to enter <br />into and execute on behalf of the City any agreements necessary for the <br />administration and enforcement of this Section in accordance with the pro- <br />visions of Section 6(3)(b), Article 10, Chapter 138, Colorado Revised Statutes <br />1963, as amended. <br /> <br />E L E C T ION AND PEN A L T Y PRO V I S ION S <br /> <br />Section 11. Election and Amendementc;. <br /> <br />11-1. Before this Sales and Use Tax Ordinance shall become effective <br />it shall be submitted to and receive the approval of a majority of the quali- <br />fied electors of the City of Louisville, voting at said g~"eral election to be <br />held on the 6th day of November~ 1973. <br /> <br />11-2. The City Council may amend, alter or change this Ordinance, <br />except as to the 2 per centum rate of tax herein imposed, subsequent to adop- <br />tion by a majority vote of the City Council. Such amendment, alteration or <br />change need not be submitted to the electors of the City for their approval. <br /> <br />Section 12. General Fund Revenues. All funds received pursuant to <br />this Ordinance shall be depositE!d into the City's General Fund. <br /> <br />Section 13. Penalty. tIny person convicted of violating any of the <br />provisions of this Ordinance shelll be punished by a fine of not to exceed <br />$300.00 or by imprisonment for not more than 90 days, or by both such fine and <br />imprisonment. <br /> <br />Section 14. Effective Date. This Ordinance shall take effect July 1, <br />1974, and shall apply to all retail sales unless exempt made on or after <br />that date. <br /> <br />Section 15. Severabili1~. If any provision of this Ordinance or the <br />application thereof to any person or circumstances is held invalid, such <br />invalidity shall not affect othE~r provisions or applications of the Ordinance <br />which can be given effect without the invalid provisions or application, and <br />to this end the provisions of this Ordinance are declared to be severable. <br /> <br />Section 16. Reasons for Emergency. In order to provide for the collec- <br />tion of sales tax by the Director of Revenue by July 1, 1974, and because the <br />revenue is necessary to provide needed services and improvements in the city, <br />the City Council fi nds that an E~mergency exi sts. <br /> <br />Section 17. Emergency. Based on the reasons set out in Section 16, <br />the City Council hereby finds, determines and declares that an emergency <br />exists and that this Ordinance "is necessary for the immediate preservation <br /> <br />-6- <br />
