<br />ORDINANCE NO. 430 <br /> <br />AN ORDINANCE PROVIDING FINANCI.AL RELIEF AND SECURITY FOR ELDERLY CITIZENS OF <br />THE CITY OF LOUISVILLE BY PROVIDING A CASH ALLOWANCE FOR QUALIFIED RESIDENTS <br />OVER THE AGE OF 65, WHICH ALLOWANCE SHALL BE BASED ON THE AD VALOREM CONTRI- <br />BUTION MADE BY SUCH ELDERLY CITIZENS TO THE CITY'S REVENUE. <br /> <br />WHEREAS, the burdens of inflation and taxation, most particularly <br />property taxation, have fallen heavily upon the elderly residents of this <br />City, causing them frequently to endure significant financial hardship and <br />placing the security of their homes in jeopardy; and <br /> <br />WHEREAS, it is the desire of the City Council to provide financial <br />relief from the aforesaid risks and burdens to the elderly persons of the <br />City of Louisville by granting a cash allowance to such persons based on their <br />respective property tax contributions to the general revenue and City Maintenance <br />Reserve Fund, whether such contribution is in the form of payment of a direct <br />property tax levy or in the form of indirect contribution by means of rental <br />payments; and <br /> <br />WHEREAS, it is provided in Section 139-33-1, 1963 C.R.S., as amended, <br />that municipal corporations shall have the power to make and publish such <br />ordinances as are necessary and proper to provide for safety, preserve the <br />health, promote the prosperitJ', improve the morals, order, comfort and convenience <br />of the municipal corporation and the inhabitants thereof; <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of <br />Louisville, Colorado, that: <br /> <br />SECTION 1. The Muni ci pa 1 Code of the Ci ty of Loui svi 11 e, 1962 is <br />hereby amended by the addition of the following Chapter: <br /> <br />Chapter 37 <br /> <br />37.1. The City Counc;'1 finds and determines that the granting of an <br />allowance to elderly residents of the City of Louisville as provided for <br />herein is necessary to the hea.lth, safety and welfare of the City of Louisville <br />and the citizens thereof and 'is for a public purpose directly related to the <br />public health, safety and welfare. <br /> <br />37.2. It is the purpose of this program to provide financial assistance <br />to the elderly residents of this City in order to ease the hardship placed <br />upon them by cost of living increases and property taxation. The program <br />shall apply to homeowners who have paid ad valorem taxes by direct levy, and <br />to renters, any portion of whose rental payments are attributable to the City's <br />property tax. <br /> <br />37.3. Every person desiring to qualify for an allowance under this <br />ordinance must submit to the City an application therefor at any time within <br />one year after December 31, 1973, for an allowance for the year 1973, and at <br />any time after December 31 of each succeeding year for each year after 1973. <br />Applications shall be made on forms to be provided by the City. No applicant <br />shall willfully make any misstatements of a material fact or willfully omit any <br />material fact on an application. No allowance shall be paid by the City under <br />this ordinance prior to August 1st of the year in which application is made. <br />Applications for an allowance shall be submitted within one year subsequent to <br />the year for which allowance is sought. <br />
