In the case of an open channel <br />ditch the developer would not be providing piping and therefore not provide crossing <br />structure. <br /> <br />Sisk asked Tom Phare what the City is responsible for maintaining with respect to the <br />ditch. <br /> <br />Tom Phare, Director of Public Works stated that the City has 20% ownership of the ditch <br />however, the Ditch Company has a right to maintain the ditch to keep the water flowing. <br /> <br />DellaCava stated that he was familiar with the ditch and the Ditch Company. He <br />concurred with Phare that the Ditch Company's primary concern will be to maintain the <br />ditch to keep the water flowing. <br /> <br />Sisk asked Wood the dollar amount of the cash-in-lieu of dedication. <br /> <br />Wood stated that the figure was calculated on a purchase price of $270,000, therefore the <br />cash-in-lieu of the 12% dedication would $32,400. <br /> <br />Sisk asked the closing date of the sale of the property in question. <br /> <br />DellaCava stated that he closed on the property in September of 1998. <br /> <br />Wood stated that it is within the ordinance to require cost estimates based upon current <br />fair market value based upon appraisal. <br /> <br />DellaCava stated that the property has been idle since the purchase. <br /> <br />Sisk asked Wood about the traffic study that reflected a 2% absorption, if that was based <br />on the 13,000 SF plan. <br /> <br />Wood stated that it was. <br /> <br />Sisk asked if that included the restaurant usage that was envisione'd. <br /> <br />8 <br /> <br /> <br />
