CITY OF LOUISVILLE
BOARD OF ADJUSTMENT
STAFF REPORT
December 21, 2011
APPLICANT: The City of Louisville
OWNER:
1.) Louis Gagliano; 1077 W. Willow St., Louisville, CO 80027
STAFF PLANNER: Gavin McMillan, AICP, Planner III
LOCATION:
1077 W. Willow St. Lot 2, Block 1, Hillsborough West
1059 W. Willow St., Lot 3, Block 1, Hillsborough West
1035 W. Willow St. Lot 4, Block 1, Hillsborough West
ZONING: Residential Rural (R -R) under the Hillsborough West Planned
Unit Development (PUD)
REQUEST:
SUMMARY:
Case #11- 044 -VA — Approval of a variance from Section
17.16.120 of the Louisville Municipal Code (LMC) to permit an
eight foot high fence where six feet is the maximum allowed.
The City of Louisville, on behalf of three property owners (1035, 1059, and 1077 W. Willow
St.), has applied for a variance to enable the property owners to construct an eight (8) foot
tall privacy fence on the rear (western) side of their respective properties. Section
17.16.120.A of the Louisville Municipal Code (LMC) states that;
No fence. wall, or hedge shall exceed six feet in height except as required for
screening. recreational purposes approved by the planning commission, or
unique security requirements approved by the planning commission.
In order to construct a fence in excess of six (6) feet high, a variance from Section
17.16.120.A of the LMC is required.
BACKGROUND
In the late 1980's, Boulder County and the City of Louisville widened and realigned
McCaslin Boulevard. This realignment included adding a curve in the road between Alder
Street and South Boulder Road. The widening and new curve in the road introduced noise
and headlight impacts to certain residences along McCaslin Blvd. To mitigate these
impacts the City constructed an approximately five hundred (500) foot section of eight (8)
foot high privacy fence adjacent to three homes on the east side of McCaslin Blvd. (1035,
1059, and 1077 W. Willow St.) as shown in the following map.
1
