Local Licensing Authority <br /> Minutes <br /> January 24, 2011 <br /> Page 3 of 5 <br /> • B. 2010 Annual Report <br /> Rommelfanger moved the Authority approve the 2010 Annual Report and <br /> forward it to City Council. Lipton seconded. All in favor. <br /> C. Discussion/Direction — Medical Marijuana <br /> Attorney Culley provided the Authority members with background information for <br /> the medical marijuana discussion: <br /> - City Council has decided to regulate medical marijuana and asked staff to <br /> prepare draft ordinances. <br /> - City Council appointed the Local Licensing Authority the body for the licensing <br /> and suspension or revocation if required. <br /> - The Authority was given the opportunity to discuss, review and comment on <br /> the enabling ordinances but there was no such requirement. <br /> - The types of licenses will be a medical marijuana center license and a medical <br /> marijuana infused products manufacturing license. <br /> - No cultivation will be allowed in Louisville. <br /> - A hearing will be conducted on a new license with distance requirements, <br /> zoning requirements and all owners, managers, financial backers and employees <br /> will be required to have background checks. <br /> - Fees are being considered by staff for the original application and annual <br /> • renewal. <br /> - Ordinance exempts primary caregivers and patients acting within the state <br /> statute and constitutional requirements. <br /> - Signage and advertising require the word "medical" to precede any reference to <br /> marijuana, no marijuana can be visible from outside and no on-site consumption <br /> will be allowed. <br /> Discussion centered on the points addressed by Attorney Culley. The Authority <br /> had no specific revisions to forward to Council currently, but asked if there was a <br /> possibility for revisions as they arise in the future. Attorney Culley confirmed <br /> Council could revise the ordinances in the future. <br /> The Authority asked staff to bring back the needed revisions to the Authority's <br /> Rules of Procedure at the February meeting if Council moves the ordinances <br /> forward. <br /> Attorney Culley asked Authority Members to look at Section 5.10.290 with regard <br /> to a filing fee for hearings. Discussion led to a consensus by Authority members <br /> to suggest a fee of$50 to $100. <br /> Police Department Reports <br /> • A. Incident Report — Ralphie's — 11/16/10 <br />
