All in favor <br /> <br />Howard asked that Council discuss and consider a Noise Ordinance at a future work <br />session. <br /> <br />RESOLUTION NO. 22, SERIES 2000 - AMENDED FINAL PUD <br />DEVELOPMENT PLAN AND MINOR SUBDIVISION REPLAT FOR THE <br />BELLA VISTA SOUTH SUBDIVISION <br /> <br />Davidson called for Staff presentation. <br /> <br />Paul Wood, Planning Director summarized the background of the Bella Vista South plat <br />and PUD. Wood stated that the plat and PUD were originally approved as a five-lot <br />development with four single-family and two multi-family residences in 1980. Wood <br />noted that in 1981, an additional lot was created through a replat, however, the PUD <br />amendment was not recorded and cannot be located and therefore the setbacks on the <br />original PUD remain in effect. Wood stated that the additional lot caused Lots 3-6 to <br />become difficult to build upon. <br /> <br />With respect to the replat and subdivision agreement, Wood stated that this is only <br />applicable to Lot 3. The lot was reduced in size to create the required Outlot, dedicated <br />to the City for an additional right-of-way for street connection. Wood stated that the <br />applicant is requesting fee in-lieu of land dedication and that Staff recommends approval <br />that would require payment of the fee prior to recordation of the plat and PUD. <br /> <br />With respect to the proposed yard and bulk regulations, Wood stated that the applicant <br />requested exception to the district requirement of setbacks. Wood noted that the Planning <br />Commission supported the requested reduction in required setbacks. However, because of <br />the higher volume of traffic on Bella Vista Drive, the 25-foot setback was not reduced <br />through this PUD and fencing is limited along Bella Vista Drive. <br /> <br />Wood stated that the Planning Commission recommends approval of the PUD <br />amendment and minor replat with conditions, and recommended that the applicant not be <br />required to landscape the Outlot being dedicated to the City for future right-of-way. <br /> <br />Davidson called for Applicant presentation. <br /> <br />Phil Geil, 897 Meadow Glen Drive, Boulder, stated that he is the Attorney representing <br />the owners of Belvista LLC. He reviewed that they began work on the project four years <br />ago. When it was realized that the PUD had not been recorded, they had to start all over. <br /> <br />10 <br /> <br /> <br />
