<br />Planning Commission <br />Meeting Minutes <br />JULY 12, 2007 <br />Page 9 of 13 <br /> <br />Paul Zawadowski, 238 S. Jefferson Ave., discussed the patio dining and it being a feature that <br />will be welcome by many within Louisville residents including himself. He asked the <br />Commission to consider what is important to Louisville as a community. <br /> <br />Richard Harrison, 337 Chestnut, stated he has lived in Louisville for 15 years and is looking <br />forward to this type of dining and a place where he can bring his family. <br /> <br />Randy Rose, 4455 Orchard is moving to 801 Spruce St. and stated his support of the project. <br /> <br />MaryAnne (unknown), 822 Lafarge, expressed her concerns with the project and how the <br />establishment will be regulated. She would support a higher fence, perhaps 8 feet. <br /> <br />Loo advised the speaker that the special review process is the mechanism that will be used to <br />regulate the business. The commission has the ability to call-up any application at anytime that <br />has been established through the special review process. <br /> <br />Doug Westerburg, stated that the Chase Bank concerns are a bigger issue, especially with the <br />drive-thru. He stated that the noise pollution be considered on all future uses for downtown. <br /> <br />David Kahn, 808 Lafarge asked the commission to consider implementing a better noise <br />ordinance because the issue is not just specific to this application. <br /> <br />Mike McMahon, Willow St. resident, stated he supports the project and what it will bring to the <br />downtown area. <br /> <br />Commission Questions of Staff and Applicant: <br />Dalton inquired of the applicant regarding the noise generated by the cooler. <br /> <br />L. Karp stated there is small a 2' x 2' compressor at ground level. It will probably not be any <br />louder then the one at Senor' T's. <br /> <br />Pritchard discussed the history of other uses for the site. He asked staff if any of them had had <br />restrictions applied. <br /> <br />McCartney stated they had not. <br /> <br />Sheets stated that non-compliance with the special review use can be addressed by the <br />Commission by a call-up review. <br /> <br />Public Hearing Closed Commission Comments: <br />Sheets stated her support of the project. <br /> <br />McAvinew stated his support of the project and reaffirmed that a review could be done at a later <br />date for the special review use. <br /> <br />Hartman stated her support the project and her appreciation to those that spoke. She also stated <br />that perhaps the Commission needs to address the noise and light pollution for the entire area. <br /> <br />Dalton stated this project is not a Druid Arms and he supports the project. <br /> <br />Loo stated there is a need for a transition between commercial and residential and she does not <br />support the project. <br /> <br />Pritchard addressed concerns with the music and lighting of the patio. He stated that in the past <br />14 years there have three (3) different bars in that location and this project seems a better fit for <br />the site.
