PAGE FOUR <br />SUBJECT: ORDINANCE NO. , SERIES 2011 — AN ORDINANCE AMENDING <br />CHAPTER 15.36 OF THE LOUISVILLE MUNICIPAL CODE REGARDING THE <br />PROCEDURES APPLICABLE TO DEMOLITION REVIEW OF BUILDINGS <br />THAT ARE OVER FIFTY YEARS OLD <br />DATE: DECEMBER 6, 2011 <br />A benefit of an application process would be that the application is a standalone procedure <br />which would trigger a demolition timeframe. The application process would remove the need <br />to use a building permit as the trigger for the review process. The Demolition Process would <br />be as follows: <br />A. Pre - application meeting with applicant and staff to review and discuss the process. <br />B. Applicant can also request a pre -filing conference with the HPC to discuss the reasons <br />for demolition. This would give the applicant the opportunity to discuss what <br />alternatives exist other than demolition. <br />C. Applicant submits application to Planning Division. <br />D. Planning Division refers submittal to museum coordinator, as well as to other internal <br />partners, for the review of the social history and other relevant matters. <br />E. Staff receives referral comments from internal partners and provides comments to the <br />applicant and HPC sub - committee. <br />F. Planning Division convenes an HPC sub - committee to discuss the eligibility of the <br />structure for Landmarking. <br />G. If the structure is determined eligible for the Landmarking, staff generates a report with <br />submittal documents for inclusion in the HPC agenda packet. <br />H. HPC hearing — HPC makes determination on stay. <br />1. Once decided, application is valid for 1 year from application date. <br />J. Staff sends letter to applicant. <br />Define the Time Limit of the Demolition Permit Application <br />LMC Section 15.36.200 provides a 180 day time frame for which a demolition permit must be <br />acted upon once issued. The purpose of this language is to create a time limit for which an <br />applicant must take action before a demolition permit is considered void. Once considered <br />void, the applicant would need to reapply and go through the process. <br />Staff recommends the following language to amend the current language: <br />M. Except as otherwise <br />provided in this section 15.36.200 for PUD final development plans and SRU plans, <br />commission action on a demolition application shall expire no later than one year after the date <br />the planning department accepts a completed demolition application if a building permit has not <br />been issued for the work described in the application. Further, if the building permit requested <br />within such one -year period is not consistent with the name on the demolition application, the <br />property owner's written explanation and /or drawings of the plan for the building, a new <br />demolition review shall be required. <br />
