• ORDINANCE NO. 1602 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CHAPTER 3.18 OF THE <br /> LOUISVILLE MUNICIPAL CODE AND ADOPTING AN UPDATED SCHEDULE OF <br /> DEVELOPMENT IMPACT FEES FOR MUNICIPAL CAPITAL FACILITIES, <br /> TRANSPORTATION CAPITAL FACILITIES, LIBRARY CAPITAL FACILITIES, <br /> PARKS AND TRAILS CAPITAL FACILITIES AND RECREATION CAPITAL <br /> FACILITIES. <br /> WHEREAS,the City Council of the City of Louisville, Colorado finds that: <br /> A. By Ordinance No. 1506, Series 2006, the City Council repealed and re-enacted <br /> Chapter 3.18 of the Louisville Municipal Code (Code) regarding the establishment of <br /> development Impact Fees; <br /> B. Pursuant to an impact fee study conducted at the time of the adoption of <br /> Ordinance No. 1506, Series 2006, the City by said Ordinance established development <br /> Impact Fees for Municipal Capital Facilities, Library Capital Facilities, Transportation <br /> Capital Facilities, Parks and Trails Capital Facilities, and Recreation Capital Facilities; <br /> • C. Section 3.18.100 of the Code provides that the Impact Fees described in Chapter <br /> 3.18 shall be reviewed at least once every five years to, among other things, ensure that <br /> the demand and cost assumptions underlying the Impact Fees are still valid, and that the <br /> resulting Impact Fees do not exceed the actual costs of constructing Capital Facilities that <br /> are of the type for which the fees are paid and that are required to serve new impact- <br /> generating development; <br /> D. New development in the City is placing and is projected to place an increased <br /> demand upon the City's Municipal Capital Facilities, Library Capital Facilities, <br /> Transportation Capital Facilities, Parks and Trails Capital Facilities, and Recreation <br /> Capital Facilities; <br /> E. The protection of the health, safety, and general welfare of the citizens of the City <br /> requires that these Capital Facilities be expanded to accommodate and serve this <br /> continuing growth within the City from new development; <br /> F. The tax and other revenues generated from new development does not generate <br /> sufficient funds to provide the necessary City Municipal Capital Facilities, Library <br /> Capital Facilities, Transportation Capital Facilities, Parks and Trails Capital Facilities, or <br /> Recreation Capital Facilities to accommodate and serve new development; <br /> • G. The adoption of an equitable Impact Fee system consistent with the requirements <br /> of applicable law is one of the preferred methods of the City for regulating land <br /> Ordinance No.1602,Series 2011 <br /> Page 1 of 7 <br />
