In the past the units were held under annual temporary <br />use permits until such time the City converted the Units to Section 131 perpetual use <br />agreements. In 2003 the Board of Directors ofthe NCWCD revised District policy <br />regarding the conversion of Temporary Use Permits. The policy no longer allows the <br />renewal of Temporary Use Permits. All current Temporary Use Permits must be <br />converted to the permanent Section 131 Contract by March 1,2005. The District's <br />guidelines provide for the use agreements to be authorized through ordinances. The last <br />ordinance converting temporary use of CBT to permanent Section 131 contracts was <br />adopted in 2004. Since then the City has accumulated 186 additional units. Therefore <br />the ordinance provides for the Mayor and City Clerk to file an application to NCWCD for <br />186 units of CBT water to be taken from temporary use contracts to annually renewable <br />perpetual water contracts per CRS 37-45-131. <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1462, Series 2005. There were no comments. <br /> <br />MOTION: Council member Van Pelt moved for approval of Ordinance No. 1462, <br />Series 2005, seconded by Council member Marsella. Roll call vote was taken. The <br />motion passed by a vote of 5-0. Absent: Council members Keany and Brown. <br /> <br />AWARD BID TO GOLDEN TRIANGLE CONSTRUCTION, INC. FOR THE <br />COMMUNITY PARK PROJECT <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Land Management Director Cindy Lair reported on January 18, 2005 the City received <br />seven bids for the Community Park Project from the following companies: <br /> <br />. Golden Triangle Construction <br />. Mark Young Construction <br />. Goodland Construction <br />. Fischer Construction <br />. Bosco Constructors <br />. J.C. Brooks & Co. <br />. Arrow J. Landscaping & Design <br /> <br />$1,772,158 <br />$1,816,255 <br />$1,931,000 <br />$1,940,411 <br />$1,961,685 <br />$2,010,000 <br />$2,105,725 <br /> <br />All seven bidders listed were pre-qualified. Of the submittals for pre-qualification, the <br />low bidder, Golden Triangle Construction, rated the highest based on the evaluation <br />criteria developed. The bid prices are lump sum base bid amounts submitted. Six "Add <br />Alternates" were also included for consideration. The project includes all machinery, <br />materials and labor necessary to install specified park improvements. Additional Project <br />Costs & Improvement not included in the contract total $91,571. The total anticipated <br />project expenditures are $2,256,304. <br /> <br />7 <br />
