Louisville City Council Meeting <br />May 16, 2000 <br />Page 10. <br /> <br />is compliant with the IDDSG. Johnstone noted that the Planning Commission approved <br />the preliminary PUD with 12 conditions, and the applicant has agreed with all 12 <br />conditions. Johnstone stated that Staff is recommending adding conditions, 7 & 8 which <br />relates to the potential for a school use. <br /> <br />Davidson called for Applicant presentation. <br /> <br />Terry O'Connor, O'Connor Development, LLC, 287 Century Drive, Louisville, stated <br />that the applicant is in compliance with all the conditions. <br /> <br />Howard asked O'Connor if compliance included conditions 7 & 8. O'Connor asked if <br />condition 7 & 8 forever prohibits a school from this property. <br /> <br />City Attorney Light stated that this Resolution clarifies and states that this plat and PUD <br />does not authorize a school on this property. <br /> <br />Howard read conditions 7 & 8 and Mr. O'Connor agreed with both conditions. <br /> <br />Sisk stated that a letter was received on April 26, 2000 from Frank Marceau, which <br />withdrew the request for a Special Use Review for a portion of Building C. Sisk asked <br />O'Connor if he was in agreement with the letter. <br /> <br />O'Connor stated that he authorized the letter. <br /> <br />City Attorney Light asked for clarification on the April 26, 2000 letter. Light noted that <br />the letter stated "no special uses, other than those set aside in the PUD, are contemplated <br />for this property". Light asked O'Connor's if he agreed that in fact, there are no special <br />review uses set aside in the PUD for CTC filing or uses by right, and that uses are by <br />Special Review. <br /> <br />O'Connor agreed that there are no special review uses on the property. <br /> <br />Sisk asked O'Connor if it was his intent to have the Peak to Peak Charter School occupy <br />these premises. <br /> <br />O'Connor stated absolutely not. <br /> <br />MOTION: Howard moved that Council approve Resolution No. 23, Series 2000 - Final <br />PUD Development Plan (AKA Tech Center Commons) and Minor Subdivision Replat <br />(Replat A) for Lots 6A, 10A, and 10B, Block 3, CTC, First Filing, as amended, seconded <br />by Keany. Roll call vote was taken. Motion passed by a vote of 7-0. <br /> <br />10 <br /> <br /> <br />
