City Council Meeting Minutes May 3, 2005 Page 10 of 16 RESOLUTION No. 15, SERIES 2005 - A RESOLUTION APPROVING SPECIAL REVIEW USE (SRU) REQUEST TO CREATE AN OUTSIDE EATING AREA LOCATED BETWEEN THE REAR OF THE BUILDING AND THE ALLEY, 700 MAIN ST., LOT 7, BLOCK 3, TOWN OF LOUISVILLE- (advertised Daily Camera 4/30/05) Mayor Sisk requested a Staff presentation. Planning Director Paul Wood reported the owner/applicant Lenny Martinelli has applied for a Special Review Use (SRU) to authorize an outside eating area for the Huckleberry Restaurant and Tea Room, located at 700 Main Street. The Louisville Municipal Code requires that outdoor dining services be approved by a SRU. Approximately 2,300 SF is proposed for the rear 50 feet of the lot. They propose a small outside patio connected to the rear of the restaurant. A concrete slab would be poured and fenced for privacy. A shade structure would be constructed to provide partial shading for 30 to 35 patrons. Landscaping strips and a planting bed would be added adjacent to Pine Street. The improvements do not create additional building improvements and therefore do not generate an additional parking requirement, but would eliminate two parking spaces. The Planning Commission held a public hearing on April 14, 2005 and approved the SRU by a vote of 6-0, with four conditions, which the applicant has agreed to. Mayor Sisk asked if the applicant wished to make a presentation. Mr. Martinelli declined to make a presentation. Mayor Sisk requested public comment. There was none. MOTION: Council member Keany moved for Council approval of Resolution No. 15, Series 2005, seconded by Council member Clabots. All in favor. Absent- Council member Brown. DISCUSSION/DIRECTION - REQUEST FOR REIMBURSEMENT OF LEGAL FEES (NANCY BOUDREAU LOVE AND RON RICHARDSON) Mayor Sisk requested an Applicant presentation. Nancy Boudreau Love, 841 Front Street, and 800 Jefferson Avenue, Louisville, CO spoke on behalf of herself and Ron Richardson. She reviewed a chronology of the events from late November 2004 through March 18, 2005. Those events led to her request for reimbursement of legal fees related to construction of the new library. Mr. Love provided invoices for legal fees from Dietze and Davis, P.C., totally $5,496.70, for legal services from March 9, 2005 though March 31, 2005. She stated the Finance Committee recommended reimbursement for only 9 out of the 39 billing hours for her attorney. She requested full reimbursement, less the cost assessed for the ethics letter from the City Attorney's office.
