<br />City Council <br />Meeting Minutes <br />May 3, 2005 <br />Page 10 of 16 <br /> <br />RESOLUTION No. 15, SERIES 2005 - A RESOLUTION APPROVING <br />SPECIAL REVIEW USE (SRU) REQUEST TO CREATE AN OUTSIDE EATING <br />AREA LOCATED BETWEEN THE REAR OF THE BUILDING AND THE <br />ALLEY, 700 MAIN ST., LOT 7, BLOCK 3, TOWN OF LOUISVILLE- <br />(advertised Daily Camera 4/30/05) <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood reported the owner/applicant Lenny Martinelli has <br />applied for a Special Review Use (SRU) to authorize an outside eating area for <br />the Huckleberry Restaurant and Tea Room, located at 700 Main Street. The <br />Louisville Municipal Code requires that outdoor dining services be approved by a <br />SRU. Approximately 2,300 SF is proposed for the rear 50 feet of the lot. They <br />propose a small outside patio connected to the rear of the restaurant. A concrete <br />slab would be poured and fenced for privacy. A shade structure would be <br />constructed to provide partial shading for 30 to 35 patrons. Landscaping strips <br />and a planting bed would be added adjacent to Pine Street. The improvements <br />do not create additional building improvements and therefore do not generate an <br />additional parking requirement, but would eliminate two parking spaces. The <br />Planning Commission held a public hearing on April 14, 2005 and approved the <br />SRU by a vote of 6-0, with four conditions, which the applicant has agreed to. <br /> <br />Mayor Sisk asked if the applicant wished to make a presentation. Mr. Martinelli <br />declined to make a presentation. <br /> <br />Mayor Sisk requested public comment. There was none. <br /> <br />MOTION: Council member Keany moved for Council approval of Resolution No. <br />15, Series 2005, seconded by Council member Clabots. All in favor. Absent- <br />Council member Brown. <br /> <br />DISCUSSION/DIRECTION - REQUEST FOR REIMBURSEMENT OF LEGAL <br />FEES (NANCY BOUDREAU LOVE AND RON RICHARDSON) <br /> <br />Mayor Sisk requested an Applicant presentation. <br /> <br />Nancy Boudreau Love, 841 Front Street, and 800 Jefferson Avenue, Louisville, <br />CO spoke on behalf of herself and Ron Richardson. She reviewed a chronology <br />of the events from late November 2004 through March 18, 2005. Those events <br />led to her request for reimbursement of legal fees related to construction of the <br />new library. Mr. Love provided invoices for legal fees from Dietze and Davis, <br />P.C., totally $5,496.70, for legal services from March 9, 2005 though March 31, <br />2005. She stated the Finance Committee recommended reimbursement for only <br />9 out of the 39 billing hours for her attorney. She requested full reimbursement, <br />less the cost assessed for the ethics letter from the City Attorney's office. <br />
