City Council
Meeting Minutes
May 3, 2005

Nancy Love reported on a meeting on February 9 with the City Attorney, City
Manager and City Staff, where the City Attorney called Ms. Love's attorney
several times during the course of the meeting. She stated in mitigation, her
property is for sale and she lost three potential sales because of the easement
issues on the property. She asked the Council to be reasonable in
reimbursement of her attorney's fees.

MOTION: Council member Keany moved that Council reimburse Nancy Love
and Ron Richardson in the amount of $2,700.00, seconded by Council member
Van Pelt. Roll call vote was taken. The motion carried by a vote of 6-0. Absent
- Council member Brown.

DISCUSSION/DIRECTION - REQUEST FROM PUBLIC SERVICE COMPANY
FOR WATER SERVICE FOR A LOCATION OUTSIDE OF THE CITY LIMITS

Mayor Sisk requested a Staff presentation.

Public Works Director Tom Phare explained Public Service Company (PSCo)
has requested water service to their proposed gas compressor station which will
be built just east of 66th Street adjacent to the Community Ditch. Any water
service outside the City requires Council approval. If Council desires, the Staff
would enter into negotiations for a service agreement. He stated this is typical of
what was allowed to purchase an outside city water service a few years ago.

City Manager Simmons asked for a description of the size and service and the
purpose of the request. Public Works Director Phare stated the size of the
service will be a %" water line service that would be used for an irrigation system
for exterior landscaping and sanitary facilities. No water will be used in the
compressor station at this point. He stated the cost for an inside the city %"
water service line would be $20,000, therefore, the fee would be $40,000.

COUNCIL COMMENT

Council member Keany asked who would construct the service line. T

The Public Works Director stated the City would install the tap, in order to insure
it's done correctly, but the bulk of the physical work would be done by Public
Service.

Council member Van Pelt asked what would be done with their waste water.
Public Works Director Phare stated they would have a septic field.

Mayor Sisk asked if this line replaces the high pressure line on Dillon Road.
Public Works Director Phare stated his understanding well with the new facility,
the Dillon Road facility would be abandoned.
