Motion passed by a vote of 6-0. <br /> <br />RESOLUTION NO. 22, SERIES 2000 - A RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN AND MINOR SUBDIVISION <br />REPLAT FOR THE BELLA VISTA SOUTH SUBDIVISION (continued from <br />512100) <br /> <br />Davidson called for Staff Presentation. <br /> <br />Ken Johnstone, Principal Planner reviewed the application, which was originally before <br />the City Council on April 4, 2000, and continued at the 4/4/00, 4/18/00 and 5/2/00 <br />meetings. Johnstone noted that the application was continued due to concerns over the <br />requested setback exceptions, the proposed public land dedication for right-of-way, and <br />the basis for calculating the fee in-lieu of land dedication. <br /> <br />Johnstone reviewed the history of the Bella Vista South parcel, which was zoned <br />Residential Low Density (R-L) when annexed in 1979. The plat and PUD originally <br />approved a five-lot development with four single-family and one duplex in 1980. In <br />1981, Replat "A" approved an additional lot, for a total of six single-family lots. A PUD <br />Development Plan was required to create the sixth lot, and comply with the R-L Zoning. <br />The PUD was never recorded as required by the Louisville Municipal Code. <br /> <br />With respect to the outlot dedication, Johnstone noted that Staff has met with the <br />applicant and the size of the outlot has been reduced by half. The dedication of the 1,380 <br />square foot outlot addresses the possible intersection reconfiguration required for a 96th <br />street connection. If Council determines that the connection to 96th is not desired, the <br />outlot could be reconveyed, in part or in total, to Lot 3. <br /> <br />Johnstone reviewed that the land dedication fee has never been paid to the City by <br />present or past subdividers. The 1980 Subdivision Agreement required the payment <br />based upon 12 % of the "total appraised value" and paid no later than two years from the <br />date of the agreement, October 1982.
