City Council
Meeting Minutes
September 20,2005

Mayor Sisk requested a Staff presentation.

Planning Director Wood explained Ordinance No. 1477, Series 2005 will annex
to the City of Louisville a 1.4-acre parcel located at the southeast corner of S.
96th Street and Dillon Road. The City acquired the property from the Schreiter
family in 2004 for right of way purposes in conjunction with the 96th Street and
Dillon Road street improvement project. The property was needed to install street
and drainage improvements at the street intersection. The improvements were
recently completed and it is necessary for the City to annex the property to clarify
the City's ownership and maintenance responsibilities for these City streets.

Ordinance No. 1478, Series 2005, if authorized, will zone to Agriculture a 1.4
acre parcel which is being annexed to the City of Louisville by Ordinance No.
1477, Series 2005. The Schreiter Property, from which the subject right of way
was acquired by the City is zoned Agricultural in Boulder County and is also
subject to the terms and conditions of the Southeast Boulder County, 96th Street
Intergovernmental Agreement ("Northwest Parkway Agreement"). Based on
adjacent land uses and applicable comprehensive planning documents, the
proposed zoning ordinance recommends the right of way parcel be designated
Agricultural (A).

Resolution No. 39, Series 2005, concludes all statutory requirements have been
met, and the property is eligible for annexation under the laws of the State of
Colorado.

Mayor Sisk requested pubic comment. There were no comments.

Mayor Sisk closed the public hearing.

RESOLUTION No. 39, SERIES 2005 - A RESOLUTION CONCERNING A
PETITION FOR THE ANNEXATION OF PROPERTY TO THE CITY OF
LOUISVILLE, COLORADO, KNOWN AS THE CITY OF LOUISVILLE S. 96TH
STREET ANNEXATION No.3, AND FINDING THE AREA PROPOSED TO BE
ANNEXED ELIGIBLE FOR ANNEXATION

MOTION: Council member Van Pelt moved for approval of Ordinance No. 39,
Series 2005, seconded by Council member Brown.
