ORDINANCE NO. 1611 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING CHAPTER 17.52 OF THE LOUISVILLE <br /> MUNICIPAL CODE TO ADOPT PROVISIONS REGARDING REQUESTS FOR <br /> REASONABLE ACCOMMODATIONS UNDER THE FEDERAL FAIR <br /> HOUSING ACT <br /> WHEREAS, the federal Fair Housing Act, 42 U.S.C. § 3601 et seq., as amended ("Fair <br /> Housing Act"), requires that local governments be prepared to make "reasonable <br /> accommodations" in order to permit housing for certain protected individuals to occur in <br /> residential areas; and <br /> WHEREAS, City staff has recommended the City Council amend Chapter 17.52 of the <br /> Louisville Municipal Code to set forth provisions regarding the processing of such requests for <br /> reasonable accommodations made pursuant to the Fair Housing Act; and <br /> WHEREAS, the Louisville Planning Commission, after notice by publication and a public <br /> hearing, has recommended the City Council deny the amendments to Chapter 17.52 set forth in the <br /> draft ordinance presented to the Commission; and <br /> WHEREAS, the City Council has reviewed the recommendation of the Louisville Planning <br /> Commission and has reviewed the amendments to Chapter 17.52 set forth in this ordinance, <br /> including revisions made to address certain concerns of the Commission; and <br /> WHEREAS, the City Council desires to adopt the amendments to Chapter 17.52 of the <br /> Louisville Municipal Code set forth in this ordinance; and <br /> WHEREAS, City Council has provided notice of a public hearing on this ordinance by <br /> publication as provided by law and held a public hearing as provided in said notice; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. Chapter 17.52 of the Louisville Municipal Code is hereby amended by the <br /> addition of a new subsection 17.52.055, to read as follows: <br /> Sec. 17.52.055. Fair Housing Act Reasonable Accommodations. <br /> A. The federal Fair Housing Act, 42 U.S.C. §3601, et seq., as amended, <br /> requires that local governments be prepared to make "reasonable <br /> accommodations" in order to permit housing for certain protected <br /> individuals to occur in residential areas. In response to a written <br /> application identifying the type of housing being provided and the portions <br /> of the Fair Housing Act that require reasonable accommodations be made <br /> for such housing, the city manager, or the manager's designee, in <br /> Ordinance No. 1611, Series 2011 <br /> Page 1 of 3 <br />
