Louisville City Council Meeting <br />July 5, 2000 <br />Page 12 <br /> <br />would be overturning the zoning and the Planning Commission's recommendation. Quiat <br />stressed that his client does not oppose to a school, only the location. <br /> <br />Peter Blackford, 177 Boulder View Lane, Boulder, CO, stated that he and his wife Jean <br />are owners of the vacant lot at 1776 Boxelder, directly behind the proposed site of the <br />Peak to Peak School. Blackford explained that they purchased this property with the <br />intention of putting a building on the site that would provide them retirement income. He <br />stated that they were flabbergasted to receive notice of a public hearing to consider <br />locating an elementary school in the former SPF building, and could not imagine anyone <br />seriously considering locating a school in a light industrial park. He stressed to invite an <br />elementary school into a light industrial park defies logic and reason. He voiced his <br />concern for the safety and well being of the children, possible restriction on businesses <br />already established nearby, and the impact on the desirability of CTC for future <br />businesses. He stated that he has consulted with a bank for a construction loan and the <br />lender's interest has diminished voicing the following concerns: 1) The impact of higher <br />insurance rates during the construction phase. 2) The possibility that the lot would require <br />fencing during construction. 3) The impact the school would have on the ability to find <br />tenants for the building. 4) Higher insurance cost for the building owners and tenants. <br />Blackford stated that allowing Peak to Peak School to locate at 1812 Boxelder would <br />violate the covenants of CTC and be unfair to established businesses and owners of <br />neighboring lots. <br /> <br />James Smittkamp, 4964 Volkgrie Drive, Boulder, CO, attorney representing the Mill <br />Family, stated that his clients are opposed to the SRU application. He noted that his <br />clients own the building located at 1722 Boxelder Street, which was recently occupied by <br />the McData Corp. His clients have invested over 7 million dollars in the construction of <br />their building and have been told that the property taxes will be $146,000 per year. He <br />noted their concern on traffic congestion impacting businesses, and the lack of an <br />evacuation plan. He voiced his concern that parents will arrive at the beginning and end <br />of the school day adding congestion to the park. He stressed that his clients were not <br />opposed to the school, however it is the wrong use in the area. <br /> <br />Audrey Berne, 3434 47th Street, Boulder, CO, stated that she has been very involved in <br />the CTC Industrial Park since 1992, and is a joint property owner of a building on <br />Boxelder Street. She reviewed that zoning was developed to ensure land use and stated <br />the reason for SRU's is to review compatibility of uses. She stressed that these are <br />emotional issues and there are two sides, however, the most important issue is that the <br />zoning is very specific. She expressed her concern that allowing the school will set a <br />precedent. <br /> <br />12 <br /> <br /> <br />
