1111111111111111111111 Boulder County Clerkl CO ORD R 11.ee 1714271 Page: 1 of 2 87/15/199783: 21P D e.ee {f ORDINANCE NO. 1233 SERIES 1996 AN ORDINANCE APPROVING THE VACATION OF AN EASEMENT WITHIN THE CITY OF LOUISVILLE WHEREAS, the City of Louisville, was granted an Easement of ten feet (10') on all sides within Tract A, Louisville North, Filing One, a parcel of property within a sUbdivision of the City of Louisville as shown on the plat of that subdivision recorded June 13, 1973, on Film 821, at Reception 69470; and, WHEREAS, the City of Louisville has granted a building permit for the construction of a condominium complex on Tract A, Louisville North, Filing One, and within the approved site plan for that development there is no use of the above described, granted Easement for the purposes therein stated on the northerly portion of that property; and, WHEREAS, there is a surveying mis-measurement in the Louisville North, Filing One Subdivision, which has in effect taken away 7.7 feet along the northern property line of Tract A, Louisville North, Filing One, Subdivision; and, WHEREAS, the existence of the Easement so granted and the impact of the mis-measurement above described adversely effects the development of the condominium project as approved, in that the northern most building in the complex is located such that the balconies cannot be built without encroaching over the Easement so granted; and, WHEREAS, the City desires to vacate a portion of the Easement, as originally granted, as it affects the northerly property line; and WHEREAS, there are no Louisville utilities located in the Easement to be vacated; and, WHEREAS, the City Council has determined that such Easement is not needed for any public use; and, WHEREAS, the Easement is not being used or held for any park purposes or for other governmental purpose; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: #'~~~ ,.
