He <br />concurred with Sisk that the application does not meet the criteria for a Special Review <br />Use, but that denial of the application might give PSCo the option of appeal. He stated <br />that PSCo has given the City an option to choose the type of pole for the project. <br />Davidson noted that the alternatives available to the City are limited. <br /> <br />Mayer reiterated his opinion that PSCo should bear the cost of the temporary upgrades. <br />He suggested proceeding by setting a timeframe for a final decision on Home Rule, and <br />allowing the citizens to cast their votes. <br /> <br />MOTION: Brown moved that Council authorize Staff and the City Attorney to write a <br />replacement Resolution 42, Series 2000 that would conditionally approve the Special <br />Review Use application for PSCo, to not authorize the payment of the $233,000 for the <br />temporary upgrades of the power lines, but to authorize the Mayor and Staff to negotiate <br />with PSCo, with regards to the language of whether this is in the course of normal <br />business, and that conditional approval be effective November of 2002, after the City has <br />the authority to determine Home Rule and financing approval based on Home Rule, <br />seconded by Mayer. <br /> <br />Davidson offered a friendly amendment that the conditional approval be subject to the <br />November 2000 ballot issue, asking citizens to approve a tax increase. <br /> <br />Brown did not accept with the amendment. <br /> <br />COUNCIL DISCUSSION <br /> <br />Sisk asked if the conditional approval subject to the year 2002 would allow PSCo to <br />construct their choice of poles. <br /> <br />Brown stated that there should be some mechanism to delay the type of pole used and <br />suggested further discussion. <br /> <br />Mayer offered a friendly amendment that the decision on the type of pole should also <br />have a deadline set to allow for negotiation. <br /> <br />Brown and Mayer accepted the amendment. <br /> <br />After considerable discussion, Brown withdrew his motion and Mayer withdrew his <br />second. <br /> <br />10 <br /> <br /> <br />
