Louisville City Council Meeting <br />September 5, 2000 <br />Page 8. <br /> <br />Levihn asked City Attorney Light if the PSCo application was denied, could they <br />circumvent the City and refuse to work with the City on this project. Light stated that <br />one of PSCo's options would be to challenge the denial, however there is not a judicial <br />precedent. <br /> <br />Public Works Director Phare reviewed a preliminary summary of financing scenarios and <br />costs estimate for the power line under-grounding project. The burial project begins at <br />Continental View Estates and ends at Arista Hospital. It is an 8.7 million-dollar project <br />and is 100% financed. The annual payment is approximately I million dollars. The <br />assessed value of the property in that 500-foot swath is approximately 24 million dollars. <br />The mill levy is approximately 42 and the annual cost for 20-years on a $200,000 home <br />would be $814.00. <br /> <br />Sisk asked Diehl if PSCo would consider other alternatives and allow the City to continue <br />this Special Review Use application until April of 2001. He explained that the additional <br />time would allow the City to investigate the various financing methods. Diehl stated that <br />there are technical limitations that prohibit waiting. He noted that the summer peak <br />demand would have to be taken into consideration. Diehl stated that the temporary <br />measures would require twelve weeks for delivery of materials needed to provide for the <br />summer peak months. Diehl noted that the timeframe was outlined at the citywide <br />meeting. <br /> <br />Sisk commented that the Home Rule issue might be resolved as soon as April of 2001and <br />asked if PSCo could allow the City to continue this matter until then. Diehl asked for a <br />five-minute recess to consult with PSCo engineers. <br /> <br />Davidson called a recess at 8:35 p.m. <br /> <br />Davidson called the meeting back to order at 8:42 p.m. <br /> <br />Michael Diehl stated that they would be willing to offer the same temporary measures to <br />the City and alter the date to May 1, 2001. The amount for the temporary upgrades would <br />also change. Diehl stated that PSCo would like to have approval of the Special Review <br />Use application. He stated that if it is determined that burial is not an option, PSCo <br />would request the authority to pursue the proposed project. <br /> <br />Mayer asked if the undergrounding of the lines could be rerouted, thereby shortening the <br />distance and significantly reducing the cost. Diehl stated it would be difficult as PSCO <br />currently has the right-of-way for the power lines and would have to obtain new right-of- <br />ways from landowners on any re-routing of the power lines. He doubted that PSCo could <br />condemn property for those rights, given they already have a right-of-way. <br /> <br /> <br />
