<br />S-2- <br /> <br />annexed will not have the effect of extending the boundary of the <br />City of Louisville more than three miles in any direction from any <br />point of the boundary of the City of Louisville in anyone year; <br />and <br /> <br />WHEREAS, the City has a plan in place, pursuant to C.R.S. ~31- <br />12-105 (1) (e); and <br /> <br />WHEREAS, the City Council, by resolution, has determined that <br />the petition is in substantial compliance with the applicable laws <br />of the State of Colorado, that the area proposed to be annexed is <br />eligible for annexation, and further has determined that an <br />election is not required, and further found that no additional <br />terms and conditions are to be imposed upon said annexations except <br />any provided for in said petition. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The annexation to the City of Louisville of the <br />property described in Exhibit A, attached hereto and incorporated <br />herein by this reference, and known as the Southeast Louisville <br />Annexation - South 96th Street & Dillon Road No.1, is hereby <br />approved and annexed to the City of Louisville. <br /> <br />Section 2. The annexation of said territory is subject to the <br />conditions provided for in the petition for annexation of said <br />property filed with the City of Louisville. <br /> <br />Section 3. The City Council herewith finds, determines, and <br />declares that this ordinance is necessary for the immediate <br />preservation of the public health and safety in order to preserve <br />the integrity of the planning area of the City of Louisville <br />adj acent to the annexed territory, to insure that development <br />within such area is consistent with the City'S comprehensive plan <br />and to protect the City from undesirable and inconsistent <br />development which may otherwise occur within the planning area, and <br />this ordinance shall take effect upon adoption and signing by the <br />Mayor if approved by three-fourths of the members of the City <br />Council. <br /> <br />INTRODUCED, READ, PASSED ON FIRST READING, AND ORDERED <br /> <br />2 <br />
