<br />ORDINANCE NO. 1211 <br />SERIES 1996 <br /> <br />AN ORDINANCE ALLOWING THE LOUISVILLE CITY COUNCIL TO <br />WAIVE OR DEFER CERTAIN ANNEXATION AND SUBDIVISION <br />REQUIREMENTS WHICH ARE NOT REQUIRED BY STATE LAW. <br /> <br />WHEREAS, Section 16.32.030 of the Louisville Municipal Code <br />sets out certain requirements which are not required by state law <br />and which are particularly appropriate where development on the <br />annexed land is proposed to occur soon after annexation; and <br /> <br />WHEREAS, there may be proposed annexations of land on which <br />development is not intended to occur soon after annexation and for <br />which development requirements are more logically imposed at the <br />time of development rather than at the time of annexation; and <br /> <br />WHEREAS, it would be beneficial for the City to have the <br />flexibility to consider under different standards, annexations of <br />land on which development is not proposed soon after annexation. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section <br />1. Section 16.32.030 of the Louisville Municipal Code is hereby <br />amended by the addition of the following new subsection: <br /> <br />16.32.030 Development requirements. <br /> <br />J. The City Council may, in its sole discretion, <br />waive any of the requirements set out in subsections B, <br />C, and E through H of this section, or defer to a later <br />date any of the requirements set out in subsections E <br />through H, for the annexation of land if the owner(s) <br />thereof agree in writing not to propose significant <br />development of the land for a period of time acceptable <br />to the City Council. <br /> <br />Section 2. Chapter 16.32, Annexation Standards, of the <br />Louisville Municipal Code is amended by the addition of a new <br />Section 16.32.035 to read as follows: <br /> <br />16.32.035 Subdivision dedication requirement. <br /> <br />A. Prior to annexation of the land, the City Council <br />may, ln its sole discretion, waive or defer to a later time, <br />any or all of the dedications required in Section 16.16.060 if <br />the owner of the land to be annexed to the City agrees in <br />writing not to propose significant development of the land for <br /> <br />1 <br />
