City Council <br /> Meeting Minutes <br /> March 6, 2012 <br /> Page 4 of 12 <br /> Staff recommended approval of Resolution 20, Series 2012, which authorizes a <br /> Business Assistance Package similar to those recently, offered to other new retail <br /> ventures in the City, contingent upon the opening of the store no later than December <br /> 31, 2012. The requested assistance would be funded by incremental new sales tax from <br /> the project. The package to Wild Woods is consistent with a $90,000 investment. The <br /> proposed BAP includes the following provisions: <br /> • Rebate 40% of the incremental sales tax revenues collected by the City and <br /> attributable to retail sales from new business activity in the City of Louisville for <br /> the first three years of operation. <br /> • Incremental assistance would NOT be provided if Wild Woods has not <br /> commenced operation on or before December 31, 2012. <br /> • Total assistance would be capped at $18,000. <br /> • The City would receive full benefits from permit fees <br /> • The maximum three-year rebate would run concurrently with the opening and <br /> first three years of operation of the restaurant. <br /> • In the event that within 5 years of the commencement of the rebate term, this <br /> restaurant terminates their business for any reason, Wild Woods would pay back <br /> the total amount of sales tax rebated by the City. <br /> MOTION: Councilor Keany moved to approve Resolution No. 20, Series 2012, <br /> seconded by Councilor Yarnell Roll call vote was taken. The motion carried by a vote <br /> of 6-0. Absent: Mayor Pro Tern Dalton. <br /> DISCUSSION/DIRECTION — LOVRIEN CONSERVATION EASEMENT, 750 ST. <br /> ANDREWS LANE <br /> Planning Director Russ requested this matter be reviewed later on in the meeting as the <br /> applicants were not yet present. Mayor Muckle stated the Council would consider the <br /> next agenda item and then recall this discussion/direction item. <br /> UPDATE — MCCASLIN BOULEVARD/WASHINGTON AVENUE <br /> PEDESTRIAN/BICYCLE UNDERPASS <br /> Mayor Muckle requested a staff presentation. <br /> Planning Director Russ explained the Planning Division has forwarded the underpass <br /> design to the Public Works Department for the cost analysis. The project began with a <br /> public outreach last spring, to discuss a safer crossing for pedestrians and bicyclists <br /> between Harper Lake and the Davidson Mesa Open Space. Five alternatives were <br /> presented to the Public, Open Space Advisory Board, Planning Commission and City <br /> Council with the underpass alternative emerging as the preferred alternative. City <br /> Manager Fleming noted the additional materials distributed this evening were not <br /> included in the packet. <br />
