City Council <br /> Meeting Minutes <br /> March 6, 2012 <br /> Page 8 of 12 <br /> COUNCIL COMMENT <br /> Councilor Sackett stated as a member of the Coal Creek Homeowners Association in <br /> 2001, he reviewed the Lovrien's request to build their home and noted it was hotly <br /> debated. He felt the applicants should have gone before the Homeowners Association <br /> before coming to the City Council. He noted some neighbors oppose a second house <br /> on the property. <br /> Mr. Lovrien stated they are asking the Council in a preliminary process, and if the <br /> Council approves they will go before the Homeowners Association. He explained when <br /> the Coal Creek subdivision was built, the Maurer property owners felt slighted they were <br /> not included in the development and sold their property. <br /> Councilor Yarnell stated it was difficult for her to support overturning a prior Council's <br /> decision. She was open to hearing more on the proposal. <br /> Mayor Muckle stated the Open Space Advisory Board felt the property had value, but as <br /> an enclave, it did not have an open space potential. He noted there was concern over a <br /> proposed driveway crossing a trail. He noted the access to the property by way of St. <br /> Andrews Lane was advantageous to the owners and it was very clear to the Council at <br /> the time, the conservation easement was necessary. <br /> Councilor Keany stated as a member of the City Council in 2001, the discussion on this <br /> request was a very hotly contentious issue. He felt it would be very difficult for him to <br /> support their request due to the past issues. <br /> Councilor Jasiak appreciated the Lovrien's coming forward. She felt property owners <br /> should be allowed to have control over the land, but wanted to understand the history of <br /> the decision for the conservation easement. She was open to hearing their reasoning. <br /> Councilor Loo would also be open to hearing more on the proposal, but noted the <br /> conservation easement was put into place for a reason and there would have to be <br /> overwhelming evidence the conservation easement was no longer needed. <br /> Mayor Muckle hoped the Lovrien's had some indication of Council's thoughts of the <br /> matter. Mr. Lovrien stated in retrospect, they should have developed the property in the <br /> County. He stated they were given misdirection by former City officials.
