Louisville City Council Meeting <br />October 17, 2000 <br />Page 5. <br /> <br />the City to commence a voluntary annexation of the subject property located at 701 West <br />Spruce Street. <br /> <br />Wood reported that on September 19, 2000 Council directed that Ordinance No. 1344, <br />Series 2000 be continued to allow the City Attorney to prepare procedural options for <br />referring the proposed annexation to a vote. The City Attorney's procedural options are <br />as follows: 1) an election after second reading or 2) an election prior to second reading of <br />the annexation ordinance. Wood noted that staff recommends Council not consider the <br />annexation ordinance on second reading until after an election. <br /> <br />Wood stated that Mrs. Fischer has signed the required annexation agreement without <br />special condition. The agreement obligates the owner to petition for inclusion into the <br />Northern Colorado Water Conservancy District, as well as address the dedication of any <br />appurtenant water rights to the City. Wood noted that the City Attorney pointed out that if <br />Council desires to refer the question of annexation to a vote, the annexation agreement <br />should be revised to "acknowledge the exercise of legislative power by the electorate". <br /> <br />Davidson opened the public hearing and called for Applicant presentation. <br /> <br />Wayne F. Forman, Brownstein Hyatt & Farber, P.C., 410 Seventeenth Street, Denver, <br />CO, stated that he has been retained by the applicant for consulting purposes. He stated <br />that he has spoken to the City Attorney addressing the applicants' concerns. He stated <br />that the concern is the connection being made between the petition and the process of <br />acquiring the property for open space. He suggested that discussions between staff and <br />counsel continue. Forman requested that the Fischer matter be continued until the next <br />meeting in November. <br /> <br />MOTION: Mayer moved to that Council continue Ordinance No. 1344, Series 2000 to <br />the November 8, 2000 Council meeting, seconded by Sisk. <br /> <br />Mayer stated that he had questions for the City Attorney. <br /> <br />Sisk stated that he favored continuing the matter to allow further discussions. <br /> <br />Keany asked City Attorney Light a procedural question about a special election and <br />referring the ordinance to the voters. <br /> <br />Light stated that if Council wished to refer the question of annexation to a vote, a special <br />election could not be held until December. He stated that if the Ordinance is continued, <br />the question could be referred to the voters. <br /> <br /> <br />
