<br />RESOLUTION NO. 65 <br />SERIES 1996 <br /> <br />A RESOLUTION APPROVING <br />A FINAL SUBDIVISION PLAT AND PUD DEVELOPMENT PLAN FOR <br />GATEWAY <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Louisview <br />Corporation a Final Subdivision Plat and PUD Development Plan for Gateway; and <br /> <br />WHEREAS, all materials related to the Final Subdivision Plat PUD Development Plan <br />have been reviewed by City Staff and the Planning Commission and found to be in compliance <br />with the Louisville zoning ordinances, subdivision regulations, and related policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Plat PUD Development Plan, the Planning Commission recommended to the City Council <br />approval; and <br /> <br />WHEREAS, the City Council finds that said Final Subdivision Plat PUD Development <br />Plan should be approved, subject to the following conditions: <br /> <br />1. The applicant shall provide notice to the City of water rights escrow compliance. <br /> <br />2. A note should be added to the PUD stating that the existing grade on the office <br />portion of the development shall be substantially maintained. <br /> <br />3. A fence notations and graphics shall be removed from the Final PUD site plan <br />(sheet two of the PUD submittal). <br /> <br />4. Note No.2 on the fence plan shall be revised to state, "No solid privacy fencing <br />is allowed within the front setback as measured as the actual distance between the <br />front of structure and the property line." <br /> <br />5. Note No.3 on the fence plan shall be modified to reflect a minimum setback for <br />a privacy fence from McCaslin Blvd. as 80 feet rather than 50 feet. <br /> <br />6. Note No.3 on the cover sheet of the PUD concerning access shall be modified as <br />follows: "ACCESS TO THE SITE FROM MCCASLIN BLVD. AND/OR SOUTH BOULDER <br />ROAD MAY BE MODIFIED IN THE FUTURE BY THE CITY. IF, AT ANY TIME IN THE <br />FUTURE, IT IS DETERMINED BY THE CITY THAT SUCH MODIFICATION IS APPROPRIATE <br />TO ENHANCE TRAFFIC FLOW ON ONE OR MORE SURROUNDING STREETS, OR TO <br />MITIGATE AN UNSAFE SITUATION, UPON NOTIFICATION FROM THE CITY, PROPERTY <br />OWNERS ON LOT 1, BLOCK 2 (COMMERCIAL OFFICE) AGREE TO MAKE SUCH <br />MODIFICATIONS ON AND ADJOINING SOUTH BOULDER ROAD, AS MAY BE <br />REASONABLY REQUIRED BY THE CITY, AND AGREE TO PAY FOR THE COST THEREOF, <br />AS REASONABLY ALLOCATED AMONG PROPERTY OWNERS BY THE CITY.
