City Council Meeting Minutes March 20, 2012 Page 6 of 10 licenses to include Brewpubs and Vintner's Restaurant licenses and clarifies that the Local Licensing Authority may issue any class of liquor license the State Statute may allow. The following items concerning alcohol beverages are outdated or in conflict with State Statute: Section 5.08.020 attempts to regulate the hours 3.2 beer can be sold in the City; the license class for Beer and Wine licenses requires word changes; changes to the section concerning definitions (9.22.010) point to State Statute to provide for this section to remain current with any amendments being made by the State and the phrase "malt, vinous, or spirituous liquors" or "alcoholic beverages" has been changed throughout to "alcohol beverages" to reflect the same wording change in State Statute. Mayor Muckle requested public comment and hearing none, closed the public hearing. MOTION: Mayor Pro Tem Dalton moved to approve Ordinance No. 1612, Series 2012, seconded by Councilor Yarnell. Roll call vote was taken. The motion carried by a vote of 6-0. Absent: Councilor Jasiak. RESOLUTION No. 25, SERIES 2012 — A RESOLUTION APPROVING A PRELIMINARY PLAT, PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD), AND SPECIAL REVIEW USE (SRU)TO PERMIT THE CONSTRUCTION OF FIVE (5) BUILDINGS, THREE (3) OF WHICH WILL CONTAIN A TOTAL OF 195 APARTMENT UNITS AND STRUCTURED PARKING, AND TWO (2) OF WHICH WILL CONTAIN 10,000 SQUARE FEET OF RETAIL DEVELOPMENT, ON TRACT ONE OF THE LOUISVILLE NORTH, FILING 7 SUBDIVISION LOCATED AT 707 E SOUTH BOULDER ROAD (SAFEWAY REDEVELOPMENT) (City is Rescheduling to 04/03/12) Planning Director Russ explained the Planning Commission will take final action on the proposal on March 22, 2012. Staff is recommending the City Council reschedule Resolution No. 25, Series 2012 to April 17, 2012 to allow time for a full evaluation of the applicant's options. MOTION: Mayor Muckle moved to reschedule Resolution No. 25, Series 2012 to April 17, 2012, seconded by Mayor Pro Tem Dalton. City Attorney Light explained the original staff recommendation was to continue the resolution to April 3, 2012. Staff is now recommending Resolution No. 25, Series 2012 be continued to April 17, 2012. VOTE: All were in favor. Absent: Councilor Jasiak. PRESENTATION - 2011 ENERGY REPORT Mayor Muckle requested a staff presentation.
