RESOLUTION NO. 01 <br />SERIES 2012 <br />A RESOLUTION RECOMMENDING DISAPPROVAL OF A PRELIMINARY PLAT, <br />PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD), AND SPECIAL REVIEW <br />USE (SRU) TO PERMIT THE CONSTRUCTION OF FIVE (5) BUILDINGS, THREE (3) <br />OF WHICH WILL CONTAIN A TOTAL OF 180 APARTMENT UNITS AND <br />STRUCTURED PARKING, AND TWO (2) OF WHICH WILL CONTAIN 10,000 <br />SQUARE FEET OF RETAIL DEVELOPMENT, ON TRACT ONE OF THE LOUISVILLE <br />NORTH, FILING 7 SUBDIVISION LOCATED AT 707 E SOUTH BOULDER ROAD. <br />WHEREAS <br />, there has been submitted to the Louisville Planning Commission an <br />application for approval of a preliminary plat, preliminary planned unit development <br />(PUD), and special review use (SRU) to permit the construction of five (5) buildings, <br />three (3) of which will contain a total of 195 apartment units and structured parking, and <br />two (2) of which will contain 10,000 square feet of retail development, on tract one of the <br />Louisville North, Filing 7 subdivision located at 707 E South Boulder Road; and <br /> WHEREAS, <br />the Planning Commission held a duly noticed public hearing on <br />February 9, 2012, continued to February 23, 2012 and March 8, 2012, where evidence <br />and testimony were entered into the record, including without limitation the application <br />and supporting materials, the Louisville Planning Commission Staff Report dated <br />February 9, 2012, the applicant’s proposed modification of the application submitted <br />February 28, 2012, which modification reduced the number of apartment units from 195 <br />to 180 and made related design changes while maintaining the original layout; referral <br />agency comments; and additional written statement and other documents, as well as <br />testimony from the staff, applicant, residents in the area and other witnesses; and <br />WHEREAS, <br />the Planning Commission by this Resolution desires to set forth its <br />findings, conclusions and ruling with respect to the application. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />Section 1 <br />. The foregoing recitals are incorporated herein. <br />Section 2 <br />. Based on the testimony of the witnesses and the documents and <br />other evidence made a part of the record of the hearing before the Planning <br />Commission, the Planning Commission finds as follows: <br /> a.
