planned unit development are set forth in Chapter 17.28 of the Louisville Municipal Code, <br />and primarily in Section 17.28.120 of that Chapter. <br />Section 3. <br /> Based on the foregoing findings and the evidence and testimony <br />presented at the hearing, the Planning Commission hereby concludes that the application <br />should be denied for the following reasons: <br /> a. The proposed SRU does not meet special review use criteria A.2 of Section <br />17.40.100 of the LMC. In particular, the applicant has failed to demonstrate that “such <br />use/development will lend economic stability, compatible with the character of any <br />surrounding established areas.” In this regard, Planning Commission concludes that <br />although the proposal would lend economic stability, the scale and density of the proposal <br />would not be compatible with the nearby single-family residential neighborhoods. <br /> b. The requested variances to height, density, setback, and parking standards <br />requested in the preliminary PUD do not meet the criteria for variances in Section <br />17.28.110 of the LMC. In particular, the Planning Commission concludes that the <br />proposed public benefits of a public plaza, an expanded multi-use path along South <br />Boulder Road, an expanded sidewalk along Centennial Drive, the dedication of a <br />deceleration lane on South Boulder Road, the retention of the large trees along South <br />Boulder Road, the removal of the invasive Russian Olives on the north of the property, and <br />the proposed public face of the site do not warrant an increase in height from 35 feet to 52 <br />feet, an increase in the number of residential units from 127 to 180, a decrease in the <br />required parking from 390 spaces to 323 spaces, and reductions in the required setbacks <br />from 30 feet to 15 feet along South Boulder Road and from 20 feet to 10 feet along <br />Centennial Drive. The requested variances would result in a project of a scale and density <br />that is not appropriate to the surrounding area. <br /> c. The proposed PUD does not meet criteria B.15 of Section 17.28.120 of the <br />LMC. In particular, the Planning Commission concludes that the proposed PUD is not <br />compatible with surrounding designs and neighborhoods. The height and density of the <br />project does not reflect that found in the single and multi-family neighborhoods <br />surrounding the proposed PUD. <br />Section 4. <br /> In accordance with the above findings and conclusions, and based <br />upon the evidence and testimony presented at the hearing, the Planning Commission of <br />the City of Louisville hereby recommends denial of the proposed preliminary plat, <br />preliminary PUD, and SRU to permit the construction of five (5) buildings, three (3) of <br />which will contain a total of 180 apartment units and structured parking, and two (2) of <br />which will contain 10,000 square feet of retail development, on tract one of the Louisville <br />North, Filing 7 subdivision located at 707 E South Boulder Road. <br />3 <br />
