Planning Commission <br />Meeting Minutes <br />March 8, 2012 <br />Page 13of 16 <br />on Lot 8 which will screen activity on the second story porch from the <br />residential lot to the south (507 Front Street). The structure will require <br />issuance of a building permit and will be reviewed by the City of Louisville <br />Department of Planning and Building Safety to ensure adequateprivacy <br />screening is provided. <br />3.Prior to recordation of the subdivision plat, the applicant will pay all applicable <br />City of Louisville permit and tap fees associated with the creation of a new <br />residential lot. These fees include, but are not limited to, water tap fees and <br />sewer fees. <br />Commission Questions of Staff: <br />Brauneis asked if staff had evaluated all potential issues, such as loss of parking for <br />existing house. <br />McMillan stated there is no loss of parking. <br />Brauneis asked,if as presented, does anything prohibit the existing garage to be <br />used as dwelling space. <br />McMillan stated no. <br />Russell asked for the Variance Criteria to be read. <br />McMillan read the criteria and stated all six criteria must be met for approval by the <br />Board of Adjustment. <br />Russell asked if Lot 8 were vacant could it be build to conform. <br />McMillan stated yes. <br />Moline requested a clarification of Russell’s question. <br />Russell restated his question. <br />Tengler asked why the lot isn’t just being split in half. <br />McMillan stated the applicant wanted to keep as much space as necessary for a <br />backyard. <br />Moline stated it is obvious this is an accessory unit. He asked if it is the commission’s <br />job to create such a strange use. <br />McMillan stated as longas the decision is based on current design standards of Old <br />Town. <br />Applicant Presentation: <br />Rich Lopez, representing the applicant, stated the applicant had considered moving <br />the building 5’ to the east but the cost was prohibiting. While meeting with staff it was <br />suggested perhaps the Parbois PUD could be amended to include the two lots. He <br />stated they consider this request to be the minimum modifications. He stated if the <br />application is denied the structure will have to be moved 5’ or demo’d. <br />CommissionQuestions of Applicant <br />Lipton asked if the applicant had gotten a building permit and did they receive a <br />Certificate of Occupancy. <br />Lopez stated they did but only as an accessory structure. <br />
