Brauneis made a motion to enter the documents into <br />record and Pritchard seconded the motion. <br />Commission Questions of Staff: <br />Russell asked why there is height limits established in the Louisville Municipal Code <br />(LMC). <br />Russ stated the following: <br /> To create character for the community <br /> To protect the views of the community <br /> To protect from the negative impact of shadows. <br />Russell asked what staff used to justify the waivers. <br />Russ stated Section 17.28.110 and 17.28.120 were criteria used to justify the <br />waivers. Staff believes the criteria supported the requested waivers. <br />Russell verified the Special Review Use (SRU) is needed for uses that are permitted <br />in the zone district but need further review. <br />Russ answered in the affirmative. He added the Village Condominiums, adjacent to <br />the north and in the Commercial Community (CC) zone district, needed a similar <br />review. <br />Russell inquired more information regarding the traffic analysis. <br />Russ answered traffic is measured by Average Daily Trips (ADT) and retail uses are <br />typically closed in the morning but have peak trips in the evening. Residential <br />typically spreads their ADT throughout the day, so the ADT’s between retail and <br />residential will always be different. <br />Russell asked why there isn’t a decel lane on South Boulder Road planned at this <br />time. <br />Russ answered it is not warranted. He added the inclusion of the decel lane would <br />result in the removal of the existing mature street trees along South Boulder Road. <br />Russell inquired what the height of the existing building is. <br />Russ answered 27 feet. <br />O’Connell inquired if there were any other developers interested in this property. <br />Russ stated he would defer that question to the Economic Development Director, <br />Bonnie Star. <br />Star answered there was one other contract on this property but they left after 3 <br />months. <br />Tengler inquired why staff referred to the Downtown Design Guidelines in this <br />presentation when this development is not located in downtown. <br /> <br />
